Regulations of Yunnan Province on Forest Fire Prevention

Chapter I General Provisions Article 1 In order to effectively prevent and put out forest fires, safeguard the safety of people's lives and property, protect forest resources and biodiversity, and maintain ecological security, these Regulations are formulated in accordance with the Forest Law of People's Republic of China (PRC), the Regulations on Forest Fire Prevention of the State Council and other relevant laws and regulations, combined with the actual situation of this province. Article 2 These Regulations shall apply to the prevention and fighting of forest fires outside cities within the administrative area of this province. Article 3 Forest fire prevention shall follow the principles of putting prevention first and actively fighting, and adhere to the principles of putting people first, giving priority to professional teams, combining specialized groups, taking responsibility at different levels and territorial management. Article 4 People's governments at all levels shall strengthen their leadership over forest fire prevention, establish and improve the target management responsibility system for forest fire prevention, and implement the chief executive responsibility system. The main person in charge of the government is the first person in charge of forest fire prevention, and the person in charge is the main person in charge. Article 5 The people's government at or above the county level shall set up a forest fire prevention headquarters composed of the person in charge of the people's government at the same level as the commander, relevant government departments, local garrison, armed police force and forest aviation fire control institutions, and be responsible for organizing, coordinating and guiding the forest fire prevention work within their respective administrative areas.

The office of forest fire prevention headquarters is located in the administrative department of forestry of the people's government at the same level, and its institutional setup and staffing are implemented in accordance with relevant state regulations.

Township (town) people's governments and sub-district offices with forest fire prevention tasks shall set up a forest fire prevention headquarters, with the person in charge as the commander and full-time or part-time personnel. Article 6 The people's governments at or above the county level shall incorporate forest fire prevention into the national economic and social development plan, incorporate forest fire prevention funds into the fiscal budget at the corresponding level, and strengthen the work of prevention, fighting and basic guarantee.

The people's governments at or above the county level shall encourage and support the business units and individuals of forests, trees and woodlands to participate in forest fire insurance and improve their ability to resist forest fire risks. Seventh forestry administrative departments of the people's governments at or above the county level shall be responsible for the supervision and management of forest fire prevention within their respective administrative areas.

Other relevant departments of the people's governments at or above the county level shall be responsible for forest fire prevention in accordance with the division of responsibilities. Article 8 Village (neighborhood) committees with forest fire prevention tasks shall, according to actual needs, establish forest fire prevention organizations, formulate village rules and regulations, organize business units and individuals of forests, trees and woodlands to sign defense agreements, establish defense mechanisms, and do a good job in forest fire prevention work within their responsibilities.

Forest, forest and woodland management units and individuals are responsible for forest fire prevention work within their business scope, and implement forest fire prevention management and protection personnel and measures. Article 9 People's governments in neighboring administrative regions shall determine forest fire prevention zones, establish joint defense organizations and systems, and do a good job in forest fire prevention in joint defense zones. Article 10 People's governments at all levels in border areas should actively guard against the invasion of foreign mountain fires and protect people's lives and property and national ecological security. Article 11 It is the duty of every citizen to prevent forest fires and protect forest resources.

Units and individuals that have made outstanding contributions in forest fire prevention work shall be commended and rewarded by the people's governments at all levels or the forest fire prevention headquarters. Chapter II Prevention of Forest Fires Article 12 The period from February 12 to 1 to June 15 of the following year is the province's forest fire prevention period, and the period from March/kloc-0 to April 30 is the province's forest fire prevention period.

The provincial people's government may, according to special circumstances, issue an order to adjust the forest fire prevention period and the forest high fire risk period.

The people's governments at the state (city) and county level can adjust the forest fire prevention period and high fire risk period according to the local natural conditions and the law of fire occurrence, report them to the forest fire prevention headquarters of the people's government at the next higher level for the record, and announce them to the public. Thirteenth people's governments at or above the county level may, according to the characteristics and danger degree of forest fires, delimit forest fire prevention zones and forest high fire danger zones, and announce them to the public.

During the period of high forest fire risk, all outdoor use of fire is prohibited in the forest fire prevention area. Article 14 The people's governments at or above the county level shall establish and improve the forest fire warning, monitoring and information release system, strengthen the construction of automatic meteorological monitoring stations for forest fire, and improve the accuracy and timeliness of meteorological forecasting and early warning for forest fire.

Meteorological departments at or above the county level shall provide timely information on forest fire danger weather forecast and meteorological grade forecast, implement weather modification operations, and reduce forest fire danger grade; Carry out scientific research on forest fire early warning, forest fire monitoring, lightning protection in forest areas and artificial precipitation enhancement.

Radio, television, newspapers, the Internet and other public media shall broadcast or release the meteorological early warning and forecast information of forest fire to the society free of charge according to the requirements of the forest fire prevention headquarters. Fifteenth people's governments at all levels and forest fire prevention headquarters shall, according to the meteorological early warning and forecast of forest fire, do a good job in the preparations for forest fire prevention and emergency response.

People's governments at or above the county level shall set up fire watchtowers (towers) in forest fire prevention areas, set up fire isolation zones and create biological fire isolation zones.

People's governments at all levels should strengthen forest fire prevention work in key areas such as nature reserves, scenic spots and forest parks. Article 16 People's governments at all levels, forest fire prevention headquarters and forestry administrative departments shall organize and carry out regular forest fire prevention propaganda work, popularize forest fire prevention laws and regulations and forest fire prevention safety knowledge, improve the awareness and quality of forest fire prevention of the whole people, and enhance self-prevention and self-help ability.

News, radio, television, culture, education and other units should take various forms to do a good job in forest fire prevention publicity and education.

During the period of forest fire prevention, business units and individuals of forests, trees and woodlands shall set up forest fire prevention billboards and warning signs to publicize forest fire prevention for those who enter their business scope.
