Measures for the investigation and punishment of unlicensed operation

The administrative department of culture has the right to ban unlicensed entertainment places.

In accordance with the provisions of the first paragraph of Article 14 of the Measures for Investigating and Banning Unlicensed Business.

1. "Regulations on the Administration of Entertainment Places" Article 40 Anyone who engages in business activities of entertainment places without authorization in violation of the provisions of these regulations shall be banned by the administrative department for industry and commerce and the competent cultural department according to law; When the public security department investigates public security and criminal cases, it finds that it engages in business activities of entertainment places without authorization, and it shall be banned according to law.

2. Measures for investigating and banning unlicensed operation Article 17 The illegal acts specified in Items (1) and (5) of Paragraph 1 of Article 4 of these Measures shall be investigated and punished by the licensing examination and approval department according to law, and shall be punished in accordance with the provisions of relevant laws and regulations; If there are no penalties for illegal acts in relevant laws and regulations, the licensing examination and approval department shall punish them in accordance with the provisions of Articles 14, 15 and 16 of these Measures.

3. Paragraph 1 of Article 14 of the Measures for Investigating and Banning Unlicensed Business shall be banned by the administrative department for industry and commerce according to law, and the illegal income shall be confiscated; Those who violate the criminal law shall be investigated for criminal responsibility in accordance with the provisions of the criminal law on the crime of illegal business operation, the crime of major accidents, the crime of major labor safety accidents, the crime of causing accidents with dangerous goods or other crimes; If it is not serious enough for criminal punishment, it shall be fined not more than 20,000 yuan; If the scale of unlicensed operation is large and the social harm is serious, a fine of not less than 20,000 yuan but not more than 200,000 yuan shall be imposed; Unlicensed business is harmful to human health, with major security risks, threatening public safety and destroying environmental resources. Confiscate tools, equipment, raw materials, products (commodities) and other property specially used for unlicensed operation, and impose a fine of not less than 50,000 yuan but not more than 500,000 yuan.
