Measures for the Protection and Management of Shoushan Stone Resources in Fuzhou

Article 1 In order to rationally develop, utilize and protect Shoushan Stone resources, these measures are formulated in accordance with the Mineral Resources Law of the People's Republic of China, the Regulations of Fujian Province and other relevant laws and regulations, and in combination with the actual situation of our city.

article 2 units or individuals engaged in the exploitation, processing and sales of shoushan stone resources within the territory of this municipality shall abide by these measures.

article 3 the shoushan stone mentioned in these measures refers to pyrophyllite stored on the surface or underground in shoushan township, huanxi town and rixi township of our city, which can be used as carving crafts.

article 4 shoushan stone resources are owned by the state, and will not be changed due to different ownership or use rights of the land to which they are attached. No unit or individual is allowed to occupy or destroy Shoushan stone resources.

article 5 the development and utilization of shoushan stone mine shall be carried out in accordance with the principle of "unified planning, rational layout and scientific mining", and protective mining shall be carried out. Prohibit indiscriminate mining and other destructive mining.

article 6 the people's government of Jin' an district and its competent department of geology and mineral resources are responsible for the daily management and supervision of the development, utilization and protection of Shoushan stone mineral resources.

the municipal competent department of geology and mineral resources is responsible for exploring Shoushan stone resources, making development, utilization and protection plans, and supervising the development, utilization and protection.

The public security, industry and commerce, forestry and environmental protection departments in Fuzhou and Jin 'an District, and the people's governments of Shoushan Township, Huanxi Town and Rixi Township in Jin 'an District should actively cooperate with each other to do a good job in the development, utilization and protection of Shoushan stone resources.

Article 7 Shoushan Stone may not be mined in the following areas:

1. Tourist attractions and forest-intensive areas;

2. Within 6m of power and telecommunication lines;

3. Drinking water sources and populated areas are within 3m;

4. Shoushan Stone and Tianhuangshi Nature Reserve.

article 8 the mining units of shoushan stone must be state-owned mining enterprises and collective mining enterprises above the township (town), and it is strictly forbidden for village-run collective enterprises, private enterprises or individuals to mine shoushan stone. It is forbidden to transfer mining rights without approval or subcontract them to individuals for mining.

Article 9 When applying for a Mining License, a unit that mines Shoushan Stone shall submit the following materials to the competent department of Geology and Mineral Resources of Jin 'an District:

(1) an application for registration and a map of the mining area;

(2) proof of the qualifications of the mining right applicant;

(3) mineral resources development and utilization plan;

(4) approval documents for the establishment of mining enterprises according to law;

(5) data of geological exploration in the application area;

(6) an environmental impact assessment report on the exploitation of mineral resources;

(7) other materials required by laws and regulations.

if it meets the mining conditions after examination, the competent department of geology and mineral resources of Jin' an District shall report it to the competent department of geology and mineral resources of the city for examination and approval, and issue a Mining License.

it is forbidden to exploit Shoushan stone without a license.

article 1 whoever uses land, forest land, cuts down trees or uses water resources shall go through the examination and approval procedures with the relevant departments in accordance with the relevant laws and regulations of the state.

article 11 the mining license is valid for one year. "Mining license" expires need to continue mining, the mining right holder shall, 3 days before the expiration of the validity period, to the examination and approval authority for renewal of registration; Failing to go through the renewal registration formalities within the time limit, the Mining License shall be invalid by itself.

Article 12 A unit that has obtained a Mining License to mine Shoushan Stone shall fulfill the following obligations:

(1) Carry out mine construction or mining within the approved time limit;

(2) mining within the approved mining area;

(3) pay the resource tax, mineral resources compensation fee and mining right use fee to the competent department of Geology and Mineral Resources in Jin 'an District according to law;

(4) Abide by national laws and regulations on labor safety, soil and water conservation, land reclamation and environmental protection, protect the ecological environment and ensure safe production;

(5) It should meet the qualification conditions stipulated by the state, adopt advanced mining technology and implement large-scale mining to ensure that the mining recovery rate, mining dilution rate and mineral processing recovery rate meet the design requirements.

Article 13 A unit that mines Shoushan stone by blasting shall, in addition to obtaining a legal Mining License, apply to the public security department for approval of the use of blasting materials. The public security department shall not approve the use of explosives by units that have not obtained the Mining License according to law.

article 14 units and individuals selling Shoushan stone raw ore shall obtain the approval of the competent department of geology and mineral resources, and apply for a business license from the industrial and commercial department with the Shoushan stone business license issued by the competent department of geology and mineral resources.

article 15 shoushan stone raw ore mined by units that have legally obtained mining rights, and shoushan stone raw ore mined by other units and individuals before the implementation of these measures should be sold to units and individuals that have obtained the shoushan stone business license, or publicly traded in the shoushan stone trading market established by the government.

article 16 the Jin' an district government shall organize a joint law enforcement inspection team composed of personnel from the competent department of geology and mineral resources and relevant examination and approval departments. On August 1, 25, the Asian Development Bank approved a loan of 55.8 million US dollars to help Fuzhou, the capital of Fujian Province in China, and improve the urban environment by reducing water pollution and protecting water resources.

The project will help Fuzhou improve the urban environment where 1.85 million people live by building and repairing the drainage pipeline network, maintaining the underground ditch system and strengthening the management of water resources. In particular, the project will expand the Yangli drainage pipeline system serving the east of Fuzhou, build a continuous drainage system on Nantai Island in the south of Fuzhou, and repair 13 underground ditches on Nantai Island to control pollution and prevent floods. Total * * *, will build 264 kilometers of drainage pipes and repair 35 kilometers of existing drainage pipes.

Fuzhou is a major cultural, commercial and industrial center in the Minjiang River Delta. Minjiang River, which passes through the city center of Fuzhou, is the water source for drinking, irrigation and industrial processing. However, rapid economic growth and urbanization have led to serious pollution. The water quality of urban ditches and rivers is seriously deteriorated due to a large amount of treated wastewater discharge. Most ditches are polluted by organic matter, nitrogen and phosphorus wastes.

"Inadequate management of wastewater and inadequate protection of water resources lead to the deterioration of public health, unclean urban living environment and polluted drinking water, all of which affect social and economic development." Mr. Kua added.

This project will complete the first phase of Fuzhou Yangli Sewage Treatment Plant funded by ADB in advance. The project also includes an institution building and training aimed at strengthening the management capacity of Fuzhou municipal government in wastewater treatment, and promoting the participation of private institutions in the development of urban infrastructure. A $5, aid together with a loan was used to support a demonstration action to promote a clean river plan for the poor in Nantai Island.

ADB loan will bear 3% of the total cost of the project of 18.55 million USD. The loan comes from ADB's regular sources of funds, with a term of 25 years and a grace period of 5 years. The interest rate will be determined according to the terms specified by ADB according to the London Interbank Offered Rate.

the industrial and commercial bank of China will raise 27.19 million us dollars for this project, and the Fuzhou municipal government will contribute 12.51 million us dollars.

Article 7 Old and famous trees that are more than 3 years old or are particularly precious and rare, with particularly important historical value and commemorative significance, are classified as Grade I; The rest are classified as Grade II.

the municipal landscaping department shall organize relevant experts to appraise, grade and evaluate the value of ancient and famous trees, and report to the municipal people's government for publication.
