Measures of Guangxi Zhuang Autonomous Region on Implementing the Regulations on the Administration of Breeding Livestock and Poultry

Chapter I General Provisions Article 1 In order to strengthen the protection, cultivation, production and management of breeding livestock and poultry, improve the quality of breeding livestock and poultry, and promote the development of animal husbandry, these measures are formulated in accordance with the Regulations of the State Council Municipality on the Administration of Breeding Livestock and Poultry and in light of the actual situation of this autonomous region. Article 2 All units and individuals engaged in the protection of livestock and poultry breed resources, the breeding of livestock and poultry breeds (including strains and supporting strains, the same below) and the production and operation of livestock and poultry must abide by these measures; Except for farmers who raise livestock and poultry for their own use. Third animal husbandry administrative departments at or above the county level shall be in charge of the management of livestock and poultry within their respective administrative areas.

Finance, taxation, price, quality and technical supervision, industry and commerce, environmental protection, public security, transportation, railways, customs and other relevant departments shall, according to their respective responsibilities, cooperate in the management of livestock and poultry. Article 4 The people's governments at or above the county level shall give financial support to the general survey, identification and protection of livestock and poultry variety resources, the cultivation of new varieties, the construction of livestock and poultry breeding system and the promotion of improved varieties.

Units and individuals that have made remarkable achievements in the protection, cultivation, scientific research and production of livestock and poultry varieties shall be commended or rewarded by the people's government or the administrative department of animal husbandry. Chapter II Protection of Livestock and Poultry Variety Resources Article 5 The People's Government of the Autonomous Region shall protect the important livestock and poultry variety resources within its administrative area. The list of protected varieties and specific protection measures shall be formulated separately by the administrative department of animal husbandry in the autonomous region and reported to the administrative department of animal husbandry in the State Council for the record. Article 6 The administrative department of animal husbandry in the autonomous region shall establish protected areas (fields) of livestock and poultry varieties, gene banks and testing stations in a planned way to protect important livestock and poultry varieties. Seventh import and export of livestock and poultry must apply to the administrative department of animal husbandry in the autonomous region, in accordance with the relevant provisions of the state. Chapter III Breeding and Examination of Livestock and Poultry Breeds Article 8 The administrative department of animal husbandry in the autonomous region shall, according to the distribution of livestock and poultry breed resources, natural conditions and economic conditions, organize the preparation of a breeding system plan for improved livestock and poultry breeds, which shall be implemented after being approved by the people's government of the autonomous region and reported to the administrative department of animal husbandry in the State Council for the record. Article 9 The establishment of breeding livestock and poultry farms (including breeding egg hatcheries and breeding male livestock breeding stations) shall conform to the planning of livestock and poultry breeding system and be submitted for approval in accordance with the following provisions:

(a) the establishment of national livestock and poultry farms must be approved by the administrative department of animal husbandry of the autonomous region and reported to the administrative department of animal husbandry of the State Council for approval;

(two) the establishment of original livestock and poultry farms, ancestral farms and first-class livestock and poultry farms must be reported to the administrative department of animal husbandry of the autonomous region for approval;

(three) the establishment of livestock and poultry parent farms, two kinds of livestock and poultry farms, must be reported to the regional administrative office, the municipal administrative department of animal husbandry for approval;

(four) the establishment of breeding hatcheries and breeding stations for sires must be approved by the administrative department of animal husbandry at the county level. Tenth animal husbandry administrative departments at all levels shall strengthen the guidance and management of cultivating new varieties of livestock and poultry.

Units or individuals engaged in the research on the cultivation of new varieties of livestock and poultry shall formulate corresponding technical specifications and breeding programs, and report them to the animal husbandry administrative departments at or above the county level for the record. The regional test or intermediate test of new varieties of livestock and poultry must be approved by the administrative department of animal husbandry of the autonomous region before implementation. Eleventh autonomous region animal husbandry administrative departments shall set up autonomous region livestock and poultry breeds approval committee. The autonomous region livestock and poultry breed examination and approval committee is composed of relevant experts from the departments and units of animal husbandry administration, scientific research, teaching and production, and its main responsibilities are:

(a) to implement the laws, regulations and rules on the management of livestock and poultry varieties;

(two) to formulate standards and procedures for the examination and approval of livestock and poultry varieties;

(three) responsible for the identification of livestock and poultry varieties and the identification and naming of new varieties;

(four) to guide the regional test or intermediate test of livestock and poultry varieties;

(five) responsible for handling other matters related to the evaluation of livestock and poultry varieties. Article 12 A unit or individual that declares a new breed of local livestock and poultry in the autonomous region shall submit a written application to the administrative department of animal husbandry in the autonomous region, and the administrative department of animal husbandry in the autonomous region shall decide whether to accept the application within 15 days from the date of receiving the application, and notify the applicant in writing. To declare new varieties of livestock and poultry, the following materials shall be submitted:

(1) Application for variety declaration;

(2) Work report on breeding technology;

(3) Audio-visual materials and picture materials of the declared varieties;

(four) the physical objects necessary for the declaration of varieties;

(5) Other materials related to variety cultivation. Thirteenth autonomous region livestock and poultry breeds examination and approval committee shall, within six months from the date of acceptance of the decision of the administrative department of animal husbandry of the autonomous region, put forward the evaluation opinions. If the applicant disagrees with the evaluation result, he may apply for reconsideration within fifteen days from the date of receiving the notice of the evaluation result.

The examination and approval committee of livestock and poultry breeds in the autonomous region shall give a written reply within thirty days from the date of receiving the application for reconsideration. Article 14 The identification of local livestock and poultry varieties circulating in the autonomous region and the identification and naming of new varieties shall be reported to the administrative department of animal husbandry of the autonomous region for approval after examination and approval by the livestock and poultry variety examination and approval committee of the autonomous region, and to the administrative department of animal husbandry of the State Council for the record.

The competent department of animal husbandry administration of the autonomous region shall issue variety certificates to the approved livestock and poultry varieties, publish them and include them in the local livestock and poultry variety records of the autonomous region.

For livestock and poultry varieties that need to unify technical requirements within the scope of the autonomous region, local standards shall be formulated by the administrative department of animal husbandry of the autonomous region and approved and promulgated by the administrative department of standardization of the autonomous region.

The identification of livestock and poultry varieties circulating across provinces, autonomous regions and municipalities directly under the Central Government and the identification and naming of new varieties shall be carried out in accordance with relevant state regulations.
