Regulations of Lanzhou Municipality on Controlling Smoking in Public Places (202 1 Revision)

Chapter I General Provisions Article 1 In order to control smoking, reduce the harm of tobacco smoke, safeguard public health, maintain public health environment and improve the level of urban civilization, these Regulations are formulated in accordance with the provisions of relevant laws and regulations and in light of the actual situation of this Municipality. Article 2 These Regulations shall apply to smoking control in public places within the administrative area of this Municipality (hereinafter referred to as tobacco control). Article 3 The tobacco control work in this Municipality follows the principles of government leading, departmental supervision, on-site responsibility and public participation. Article 4 The people's governments of cities and counties (districts) shall strengthen their leadership over tobacco control within their respective administrative areas and be responsible for organizing the implementation of these Regulations.

The funds needed for tobacco control work are included in the fiscal budget at the corresponding level to be guaranteed. Fifth city and county (District) people's government health administrative departments in charge of tobacco control within their respective administrative areas, and their specific responsibilities include:

(a) to study and formulate supporting policies for tobacco control;

(two) to guide and inspect the tobacco control work of relevant departments and industries;

(3) Organizing the relevant departments as stipulated in Article 6 of these Regulations to carry out joint law enforcement on tobacco control, and regularly reporting the implementation of tobacco control laws and regulations;

(4) Organizing tobacco control publicity and education activities;

(five) responsible for the design and release of unified no smoking signs;

(six) the establishment of a unified tobacco control work report, complaint telephone, e-mail and other information platforms, and establish the corresponding processing mechanism;

(seven) to handle the daily affairs of tobacco control work, and coordinate and solve the problems related to tobacco control work. Sixth city and county (District) relevant departments shall do a good job in tobacco control in accordance with the following duties:

(a) the administrative department of health is responsible for the supervision and management of tobacco control in medical and health institutions at all levels and family planning technical service institutions;

(2) The education administrative department is responsible for the supervision and management of tobacco control in schools, kindergartens and other educational institutions at all levels, and strengthens the education on the health hazards of tobacco smoke;

(three) the organs and units responsible for the supervision and management of tobacco control in the workplace of their own organs and subordinate units;

(four) the administrative department of transportation is responsible for the supervision and management of tobacco control in public transport and its related workplaces and public places;

(five) cultural tourism, public security, sports and other administrative departments are responsible for the supervision and management of tobacco control in cultural and entertainment places, hotels, stadiums and tourist attractions;

(six) the administrative department in charge of market supervision is responsible for the supervision and management of tobacco control in shopping malls (shops), restaurants, drug and medical equipment business premises and various forms of tobacco advertising;

(seven) the sub-district offices of the county (District) people's government and the township (town) people's government are responsible for the supervision and management of tobacco control in public places such as chess and cards entertainment and elderly activities in the central, provincial and foreign units stationed in Lanzhou and communities;

(eight) other relevant administrative departments, industry departments and enterprises and institutions shall do a good job in the supervision and administration of tobacco control within their respective jurisdictions. Seventh city and county (District) people's governments shall commend and reward the units and individuals that have made remarkable achievements in tobacco control.

Encourage other social organizations and individuals to participate in tobacco control. Chapter ii controlled smoking places article 8 controlled smoking places within the administrative area of this municipality are divided into prohibited smoking places and restricted smoking places.

Smoking is prohibited in all places, and smoking rooms or designated smoking areas are not allowed.

Places where smoking is restricted may set up fixed smoking rooms or designated smoking areas, and smoking is prohibited in other areas of the places. Article 9 Places where smoking is prohibited include:

(1) Indoor areas of various medical and health institutions at all levels, family planning technical service institutions, welfare homes, sanatoriums and sanatoriums;

(5) All kinds of gymnasiums, indoor areas of gymnasiums, outdoor audience seating and indoor areas of competition areas;

(six) all kinds of public places in the elevator area;

(seven) passenger buses, long-distance buses, battery cars, taxis, rail transit vehicles, ferries, trains and their waiting and ticketing indoor areas;

(8) Indoor areas of state organs, enterprises, institutions and social organizations;

(nine) other places where smoking is prohibited as stipulated by laws, regulations and rules. Article 10 Places where smoking is restricted include:

(a) restaurants, bars, cafes, teahouses and other catering service indoor areas;

(2) Indoor areas such as hotels, hotels and resorts that provide accommodation and rest services;

(three) indoor areas of public leisure and entertainment places such as song (dance) halls, bathing places, chess and cards entertainment;

(4) Indoor area of the airport.

Encourage the establishment of smoke-free restaurants, rooms, floors and other smoke-free places in restricted smoking places.

The smoking room or designated smoking area in the above-mentioned restricted smoking place shall be cancelled after the expiration of the time limit, and the smoking control in this place shall be changed from restricted smoking to no smoking. The specific time limit and scope shall be determined by the Municipal People's Government.
