Regulations of Anqing Municipality on the administration of fireworks and firecrackers

Article 1 In order to ensure public safety and citizens' personal and property safety, and reduce environmental pollution, these Regulations are formulated in accordance with the Regulations of the State Council Municipality on the Safety Management of Fireworks and Firecrackers and other relevant laws and administrative regulations, combined with the actual situation of this Municipality. Article 2 These Regulations shall apply to the discharge of fireworks and firecrackers within the administrative area of this Municipality. Article 3 The management of fireworks and firecrackers shall adhere to the principles of education and guidance, giving priority to prohibition and combining prohibition with restriction. Article 4 The Municipal People's Government shall be responsible for organizing the implementation of these Regulations.

District People's governments (park management agencies), Township People's governments and sub-district offices are responsible for the management of fireworks and firecrackers within their respective administrative areas, and strengthen organization, coordination, guidance and supervision. Fifth public security departments are responsible for the safety management of fireworks and firecrackers.

The safety production supervision and management department is responsible for the safety supervision and management of fireworks and firecrackers.

The administrative department in charge of urban management is responsible for the administrative law enforcement of illegal fireworks and firecrackers.

Industry and commerce, quality supervision, transportation, environmental protection, housing construction, education, civil affairs and other departments shall be responsible for the management of fireworks and firecrackers according to their respective responsibilities.

Radio, television, newspapers and other news media should do a good job in publicity and education on the safe discharge of fireworks and firecrackers.

Organs, organizations, enterprises, institutions and social organizations shall do a good job in the safety management of fireworks and firecrackers in their own units.

Residents' committees, villagers' committees, owners' committees and property management enterprises shall assist in the safety management of fireworks and firecrackers in this region, publicize, educate and guide residents and villagers to change their customs, and discharge fireworks and firecrackers in accordance with the law, civilization, self-discipline and safety. Article 6 Fireworks and firecrackers are prohibited in the following places:

(1) State organs;

(2) Transportation hubs such as stations, docks and airports, and safety protection zones for urban trunk roads and railway lines;

(3) Protected areas for military installations;

(four) gas stations, liquefied gas supply stations (points), oil depots, warehouses, oil (gas) pipelines and other fire-forbidden areas or other places where inflammable and explosive dangerous goods are produced, operated and stored;

(5) Safety protection zones for power transmission and transformation facilities;

(six) the built-up area of the Yangtze River coastline (flood dike and beach);

(seven) libraries, cultural relics protection and other public cultural places, medical institutions, kindergartens, schools, pension institutions;

(eight) mountains, scenic spots, parks and green spaces;

(nine) shopping malls, markets and other crowded places;

(ten) other places stipulated and announced by the Municipal People's government.

The Municipal People's Government shall set up obvious warning signs against release in places where release is prohibited. Article 7 The discharge of fireworks and firecrackers is restricted within the administrative area of this Municipality.

The specific implementation scope of Anqing City is east of Huancheng West Road, south of Zhongshan Road, west of Qintan Road and north of Jiang Yan Road.

The Municipal People's Government may, according to the situation of urban construction, adjust and expand the areas where fireworks and firecrackers are restricted in urban areas in a timely manner, and announce them to the public.

Fireworks and firecrackers are prohibited in restricted areas, except from New Year's Eve to the eighth day of the first month. Advocate no or less fireworks.

Places of worship such as funeral parlours and cemeteries that restrict the discharge of fireworks and firecrackers may discharge them at designated places.

In major festivals, celebrations and celebrations, it is necessary to set off fireworks and firecrackers, which shall be decided and announced by the Municipal People's Government. Eighth during the early warning period of heavy pollution weather, it is forbidden to set off fireworks and firecrackers within the administrative area of this Municipality.

The Municipal People's Government shall timely release early warning information of heavy pollution weather through the news media to remind the public that fireworks and firecrackers are prohibited during this period. Ninth fireworks shall meet the following safety requirements:

(a) not to pedestrians, vehicles, buildings, structures, manhole projection, throwing lit fireworks;

(two) shall not hinder the safe passage of pedestrians and vehicles and affect traffic order;

(three) fireworks shall not be set off in the corridors, aisles, roofs, balconies and windows of houses;

(4) Without permission, professional fireworks and firecrackers shall not be set off;

(5) No other discharge methods that endanger public safety and personal and property safety shall be adopted. Tenth in areas where fireworks are restricted, except funeral homes, cemeteries and other places of worship, fireworks retail outlets can be established according to law, and fireworks wholesale places and perennial retail outlets are not allowed.

Temporary sales points of fireworks and firecrackers in the restricted discharge area shall be reasonably determined by the safety production supervision and management department in conjunction with the public security department. Eleventh it is forbidden to store fireworks and firecrackers outside the storage (retail) places specified in the fireworks and firecrackers business license.

The number of fireworks and firecrackers stored by fireworks and firecrackers retail operators shall not exceed the number stipulated in the retail license. Twelfth residents' committees, villagers' committees, owners' committees and property service enterprises can organize residents, villagers, units and hotels and other service enterprises within the scope of territorial management or responsibility to formulate conventions according to law, be honest and self-disciplined, and organize and supervise the implementation. Residents, villagers and owners shall abide by this Convention.

Operators and realty service enterprises that provide services such as celebrations, weddings and funerals shall inform the clients in advance of the provisions prohibiting the discharge of fireworks and firecrackers, and discourage the discharge of fireworks and firecrackers in violation of the provisions.

State functionaries shall abide by laws and regulations and the provisions of this Municipality on the safety management of fireworks and firecrackers.
