Regulations of Lvliang Municipality on the Administration of Electric Bicycles

Chapter I General Provisions Article 1 In order to strengthen the management of electric bicycles, maintain orderly, safe and smooth road traffic, and safeguard the legitimate rights and interests of citizens, legal persons and other organizations, these Regulations are formulated in accordance with the provisions of the Road Traffic Safety Law of the People's Republic of China, the Product Quality Law of People's Republic of China (PRC), the Implementation Regulations of the Road Traffic Safety Law of the People's Republic of China and the actual situation of this Municipality. Article 2 These Regulations shall apply to the management activities such as the production, sale, maintenance, recycling, registration, traffic, parking and charging of electric bicycles within the administrative area of this Municipality. Article 3 The term "electric bicycle" as mentioned in these Regulations refers to a two-wheeled bicycle that uses the vehicle battery as an auxiliary energy source, has pedaling ability, and can realize the functions of electric boosting and electric driving.

Scooters, unicycles, balance cars and other devices driven by on-board batteries are not electric bicycles and are not allowed to drive on the road. Article 4 The management of electric bicycles shall follow the principles of management according to law, convenience for the masses, security and collaborative management. Article 5 The people's governments of cities and counties (cities, districts) shall strengthen their leadership over the management of electric bicycles, ensure capital investment, optimize the layout of public transportation networks, improve the infrastructure such as the passage, parking and charging of electric bicycles, and provide convenience for citizens to travel safely, civilizedly and green. Article 6 The traffic administrative department of the public security organ shall be responsible for the traffic safety management of electric bicycles.

The market supervision and management department is responsible for the supervision and management of the production and sales of electric bicycles and related products.

The transportation department is responsible for the supervision and management of Internet rental of electric bicycles.

The Ministry of Ecology and Environment is responsible for the supervision and management of the disposal of used batteries for electric bicycles.

Industry and information technology, urban and rural planning, housing and urban and rural construction, urban management, emergency management and other departments and fire rescue agencies shall be responsible for the supervision and management of electric bicycles according to their respective responsibilities. Article 7 The people's governments of cities and counties (cities, districts) shall establish a joint meeting system attended by traffic management, market supervision and management, urban and rural planning, housing and urban and rural construction, urban management, transportation, emergency management and other departments of public security organs to coordinate and solve major problems in the management of electric bicycles. Eighth to encourage electric bicycle owners to buy related liability insurance. Article 9 State organs, enterprises, institutions, social organizations and other organizations shall educate their personnel on traffic safety and fire safety of electric bicycles.

Education administrative departments and schools should incorporate road traffic safety and fire safety education of electric bicycles into the education of rule of law.

Press and publication, radio and television, radio and other media shall publicize the laws and regulations on the management of electric bicycles, traffic safety and fire safety for public welfare. Chapter II Production, Sales, Maintenance and Recycling Article 10 Electric bicycles produced and sold in this Municipality shall meet the national standards.

It is forbidden to produce and sell electric bicycles that do not meet the national standards and have not obtained compulsory product certification. Eleventh electric bicycle sellers shall comply with the following provisions:

(a) the establishment of purchase and sales ledger real name registration system;

(2) Publicizing the relevant information that the electric bicycles sold in a prominent position in the sales place meet the national standards and obtain compulsory product certification;

(three) to provide consumers with product certificates and car purchase invoices, and indicate the brand, model, vehicle code and motor code of the electric bicycle sold on the invoice. Twelfth electric bicycle maintenance, shall comply with the following provisions:

(a) the use of quality inspection, in line with the corresponding standards of electric bicycle parts;

(2) The repaired or replaced motor meets the rated power set by the original vehicle, and the replacement motor code shall be indicated on the invoice;

(3) The repaired or replaced battery meets the rated voltage set by the original vehicle. Thirteenth no unit or individual may carry out the following acts on electric bicycles:

(1) assembly;

(2) refitting or replacing a power plant that does not meet the national standards;

(3) Dismantling or changing the speed limit device;

(four) the installation of seats, roofs, umbrellas, high-decibel speakers, stereos and other devices that affect safe driving. Fourteenth encourage electric bicycle manufacturers and sellers to provide replacement and recycling services for used batteries. Waste batteries should be disposed of by qualified enterprises. Chapter III Registration Article 15 The owner of an electric bicycle shall apply to the traffic administrative department of the public security organ for registration within the following time limit. Those who fail to register within the time limit shall not drive on the road:

(1) An electric bicycle purchased after the implementation of these Regulations shall apply for registration within 30 days from the date of purchase;

(two) electric bicycles purchased before the implementation of these Regulations shall apply for registration within six months from the date of implementation of these Regulations;

(three) the electric bicycles purchased before the implementation of these regulations do not meet the national standards. Anyone who applies for a temporary license plate or driver's license within six months from the date of implementation of these Regulations shall not drive on the road from June 65438+1 October1day, 2024. If the state has provisions, those provisions shall prevail.

Electric bicycles are registered free of charge, and the required funds are included in the fiscal budget at the same level.
