Regulations of Guizhou Province on Combating Domestic Violence

chapter I general provisions article 1 in order to prevent and stop domestic violence, protect the legitimate rights and interests of family members, maintain equal, harmonious and civilized family relations, carry forward and practice socialist core values, and promote family harmony and social stability, these regulations are formulated in accordance with the provisions of the law of the people's Republic of China on domestic violence and relevant laws and regulations, and in combination with the actual situation of this province. Article 2 These Regulations shall apply to the prevention, treatment and rescue of domestic violence and other related activities within the administrative area of this province. Article 3 The term "domestic violence" as mentioned in these Regulations refers to the physical and mental violations committed by family members by beating, binding, mutilation, restriction of personal freedom, frequent abuse and intimidation, or by other means. Article 4 Any form of domestic violence is prohibited.

Anti-domestic violence is the common responsibility of the whole society and every family, and any unit or individual has the right to dissuade and stop the ongoing domestic violence. Article 5 Anti-domestic violence work shall follow the principle of putting prevention first, combining education, correction and punishment, and implement social governance.

Anti-domestic violence work should respect the true wishes of the victims, protect the privacy of the parties concerned, and shall not disclose the information of informants, informants and witnesses involved in domestic violence cases.

minors, the elderly, the disabled, pregnant and lactating women and seriously ill patients who suffer from domestic violence should be given special protection. Article 6 The people's governments at or above the county level shall strengthen the organization and leadership of anti-domestic violence work, establish a regular communication and coordination mechanism with the participation of relevant departments and judicial organs, incorporate anti-domestic violence work into the content of spiritual civilization construction and social governance, and include the required funds into the fiscal budget at the same level.

relevant departments such as public security, civil affairs, judicial administration, education, culture, press and publication, radio and television, people's courts, people's procuratorates, people's organizations, social organizations and medical institutions should do a good job in combating domestic violence within their respective functions and duties.

township people's governments and sub-district offices (community service management institutions) should incorporate anti-domestic violence work into their work plans and grid management, define their staff, provide financial guarantee, and do a good job in the prevention, disposal and rescue of domestic violence within their respective jurisdictions.

village (neighborhood) committees should do a good job in anti-domestic violence.

Kindergartens and schools should fulfill their obligations against domestic violence according to law. Seventh people's governments at or above the county level shall be responsible for the work of women and children (Women and Children's Work Committee) to organize, coordinate, guide and urge the relevant departments and units to do a good job in anti-domestic violence. Specific responsibilities are:

(1) organizing publicity and training activities on laws and regulations related to domestic violence, and inspecting and urging their implementation;

(2) hold meetings in due course to study and solve major problems in anti-domestic violence work;

(3) establish a multi-sectoral cooperation mechanism integrating prevention, treatment and relief of domestic violence;

(4) Establish a domestic violence monitoring and evaluation system and build an information statistics platform to realize information sharing;

(5) Support social organizations such as social work service agencies and voluntary service organizations to provide services such as mental health consultation, family relationship guidance and knowledge education on domestic violence prevention;

(6) Organize other work related to domestic violence. Article 8 People's governments at or above the county level may support enterprises, institutions and social organizations to participate in anti-domestic violence work through purchasing services and project cooperation.

units and individuals are encouraged to participate in anti-domestic violence work through donations or voluntary legal consultation and psychological counseling. Chapter II Prevention of Domestic Violence Article 9 People's governments at all levels shall incorporate the publicity of laws and regulations related to anti-domestic violence into the work plan for popularizing law, and establish and improve the publicity and education system for anti-domestic violence.

organs, organizations, grass-roots mass autonomous organizations, enterprises, institutions and other organizations should combine publicity and education on anti-domestic violence with publicity and education on the rule of law and family virtues, popularize knowledge on anti-domestic violence and enhance citizens' awareness of anti-domestic violence through activities such as the establishment of civilized families. Article 1 Public security organs, people's procuratorates, people's courts and judicial administrative departments shall carry out publicity and education on family members' prevention of domestic violence and self-protection through case interpretation and publication of typical cases of domestic violence. Incorporate knowledge and skills related to preventing and stopping domestic violence into business training, and improve the ability of relevant staff to prevent and deal with domestic violence.

judges, prosecutors, people's police, lawyers, legal service personnel and social workers should explain the law to the parties and the public in combination with specific cases, and publicize the legal knowledge of anti-domestic violence. Article 11 The civil affairs department shall guide the marriage registration authority to incorporate family virtue education and anti-domestic violence publicity into the content of pre-marital education, provide marriage and family counseling services, and distribute anti-domestic violence publicity and education materials to the parties when they register for marriage. Twelfth judicial administrative departments shall guide people's mediation organizations to mediate marriage and family disputes according to law, and prevent and reduce the occurrence of domestic violence. Article 13 Women's federations and * * * Youth League should carry out propaganda work to prevent and stop domestic violence, give play to the functions of the 12338 women's rights protection public welfare hotline and the 12355 youth rights protection and psychological consultation service hotline, provide legal, marriage, family and psychological consultation for victims, and accept complaints about domestic violence incidents.

trade unions, disabled persons' federations and other people's organizations should, in light of their work characteristics, organize anti-domestic violence publicity and education, and channel and mediate family contradictions and disputes, and assist and cooperate with the government and relevant departments to do a good job in anti-domestic violence.
