Article 1 In order to strengthen the management of funeral and interment, promote the reform of funeral and interment, and promote the construction of socialist material civilization and spiritual civilization, these Measures are formulated in accordance with the Regulations of the State Council on the Administration of Funeral and interment and combined with the actual situation of this province.
Article 2 Cremation is practiced within the administrative area of this province, and burial is prohibited, except as otherwise provided by laws, regulations or the provincial people's government.
Article 3 Local people's governments at all levels shall incorporate funeral management into the national economic and social development plan.
The civil affairs departments of local people's governments at all levels are responsible for the funeral management within their respective administrative areas.
Public security, finance, industry and commerce, health, transportation, price, construction, land, environmental protection, culture, judicial administration, ethnic and religious affairs, press and publication, radio, film and television and other departments shall, according to their respective functions and duties, do a good job in funeral management.
Article 4 State organs, social organizations, enterprises, institutions and residents' committees shall support and publicize the funeral reform, guide citizens to get rid of feudal superstitious funeral customs, and advocate civilized and thrifty funeral management.
Article 5 A funeral parlour is a service unit specializing in the transportation, preservation, cosmetic surgery, cold storage and cremation of remains.
Without the approval of the civil affairs department at or above the county level, other units and individuals shall not engage in the above funeral services.
Article 6 The remains shall be cremated in the funeral parlour; If it is really necessary to transport the body to a non-death place for special reasons, the civil affairs department at or above the county level in the non-death place shall issue a certificate and obtain the approval of the civil affairs department at or above the county level in the death place.
Seventh cremated remains must be based on the death certificate issued by the public security organ or the medical institution designated by the health administrative department of the State Council. The remains of normal dead persons shall be cremated within 72 hours. The highly decomposed remains must be sent to funeral home cremation immediately. Bodies that died of infectious diseases shall be handled in accordance with the provisions of the Law of People's Republic of China (PRC) on the Prevention and Control of Infectious Diseases.
If the body of an abnormal death needs to be temporarily preserved with the approval of the relevant department, it shall be stored in a funeral home with anti-corrosion equipment, and the preservation period shall not exceed 3 months, except in special circumstances. If it is not handled within the time limit without justifiable reasons, the funeral management department may, with the assistance of the public security organ, impose compulsory treatment on the remains. The required funds shall be paid by the responsible person; If the responsible person is not clear or there is no responsible person, it shall be paid by the local financial department.
Unknown bodies in society shall be notified by the public security organs to the funeral parlour for reception. After the public security organs make timely appraisal and go through relevant formalities, the funds needed in funeral home cremation shall be paid by the local financial department.
Article 8 Medical institutions shall strengthen the management of mortuaries, and the bodies of people who died in medical institutions shall be notified by medical institutions to the funeral parlour for timely pick-up. It is forbidden to set up mourning halls and conduct funeral activities in medical institutions.
Article 9 Respect the funeral customs of ethnic minorities. Where the remains of Hui and other ethnic minorities with burial customs are buried deeply, they shall be buried at the place designated by the local government. Voluntary cremation, others shall not interfere.
Tenth foreigners, overseas Chinese, compatriots from Hong Kong, Macao and Taiwan died during their visit, travel and work in this province, and their relatives asked to dispose of the remains on the spot, which shall be handled in accordance with the relevant provisions of the local funeral management; If their relatives request that the remains be transported abroad, it shall be handled in accordance with the relevant provisions of the state.
Foreigners, overseas Chinese and relatives of compatriots from Hong Kong, Macao and Taiwan who request that their remains and ashes be transported into this province for burial from abroad or from Hong Kong, Macao and Taiwan shall be handled in accordance with relevant state regulations.
Article 11 It is forbidden to bury ashes in coffins. The disposal of ashes should occupy as little or no land as possible. The main ways are as follows:
(a) the ground is buried deep without leaving graves;
(two) stored in the ashes hall, ashes wall, ashes tower;
(3) being buried in a cemetery or replacing a tomb with a tree;
(four) discharged into rivers, lakes and seas, except for drinking water sources;
(5) Other ways permitted by law.
Twelfth ashes buried in the operating cemetery, with the "cremation certificate" or "death certificate" to buy a grave. The tomb covers an area of no more than 0.7 square meters for a single cave and no more than 1 square meter for a double cave. Tombstones should be horizontal, and garden-style cemeteries should be established; If it is suitable to build a vertical tombstone, the height of the tombstone shall not exceed 1 m.
The service life of the tomb tower of the operating ashes cemetery is generally not more than 20 years, and the management fee of the tomb tower is not more than 20 years at a time; After the expiration of the service life of the tomb (tower), if it needs to be used continuously, it shall go through the renewal procedures and pay the use fee according to the relevant provisions.

Fourteenth funeral activities shall abide by the provisions of the city appearance, environmental sanitation and traffic management, and shall not interfere with public order or infringe upon the legitimate rights and interests of others.
It is forbidden to carry out feudal superstitious activities such as watching Feng Shui, marrying relatives, burning paper, burning Mingbi, and scattering paper money during the funeral.
It is forbidden to put bodies, set up Peng Ling, offer wreaths or engage in other funeral activities in public places such as streets and highways. Where a religious ceremony is held for a funeral, it shall be held at an approved place for religious activities.
Article 15 It is forbidden to produce and sell coffin, mingbi, paper paper and other funeral articles for burial.
Coffins and remains with special needs shall be produced and sold at places designated by civil affairs departments.
Article 16 The quantity and layout planning of funeral service facilities such as funeral parlours, cemeteries and columbariums shall be put forward by the civil affairs department of the provincial people's government according to the funeral work planning and funeral demand within the administrative area of this province, and submitted to the provincial people's government for examination and approval.
Seventeenth the construction of funeral service facilities shall perform the following examination and approval procedures:
(a) to establish a funeral home, the civil affairs department of the local people's government at the county level or the civil affairs department of the municipal people's government with districts shall put forward a plan and report it to the people's government at the same level for examination and approval;
(2) The establishment of an operating ashes cemetery, an ashes hall (tower) and an operating funeral service station shall be examined by the civil affairs department of the local people's government at or above the county level, submitted to the civil affairs department of the provincial people's government for examination and approval, and registered with the administrative department for industry and commerce after obtaining approval;
(three) the use of foreign capital to build funeral service facilities, in accordance with the relevant provisions;
(four) the establishment of township public funeral service stations, public cemeteries and public columbariums (towers) shall be examined and approved by the civil affairs departments of the people's governments at the county level.
The construction of funeral facilities shall go through the relevant procedures of land use and construction according to law.
Eighteenth new, expanded funeral homes and other funeral service facilities required funds should be included in the local capital construction plan.
Due to the needs of construction, funeral homes, cemeteries and other funeral service facilities are relocated, in accordance with relevant regulations.
Nineteenth funeral homes, operating cemeteries and other funeral service units should set up services according to local conditions, provide good services for the masses to do funerals, and meet the funeral consumption needs of different levels.
Fees for services provided by funeral parlours, operating cemeteries and other funeral service units shall be reported to the price department for examination and approval, and the price shall be clearly marked.
Funeral service units shall establish and improve various rules and regulations, implement procedural and standardized work, and put an end to misplacing remains, hair and ashes.
Twentieth local people's governments at all levels shall commend and reward units and individuals that have made outstanding contributions to the funeral reform and funeral undertakings.
Twenty-first in violation of the provisions of the second paragraph of Article 5, Article 6, paragraphs 1 1, 13 and 1 of these measures, the civil affairs department shall order it to make corrections within a time limit; Refuses to correct, can be enforced.

Twenty-fourth unauthorized changes in the nature of the use of public cemetery, the civil affairs department shall order it to make corrections within a time limit, and may impose a fine of 5000 yuan to 30000 yuan; Violation of industrial and commercial administrative regulations shall be dealt with by the administrative department for industry and commerce according to law.
Article 25 Where funeral facilities such as funeral parlours, operating cemeteries and operating columbariums are built without approval, the civil affairs department shall, jointly with the construction and land administrative departments, order it to make corrections within a time limit, confiscate the illegal income, and may impose a fine of more than/kloc-0 and less than 3 times the illegal income; Those who illegally occupy land to build funeral facilities or arbitrarily change the nature of land for funeral facilities shall be punished in accordance with the provisions of land management laws and regulations.
Twenty-sixth in violation of the provisions of article 14 of these measures, shall be stopped by the civil affairs department; If it constitutes a violation of public security administration, it shall be punished by the public security organ according to law; If a crime is constituted, criminal responsibility shall be investigated according to law.
Twenty-seventh hinder or interfere with the funeral management staff to perform official duties, the public security organs shall give administrative penalties for public security; If a crime is constituted, criminal responsibility shall be investigated according to law.
Twenty-eighth if a party refuses to accept a specific administrative act, it may apply for administrative reconsideration or bring an administrative lawsuit according to law.
Article 29 These Measures shall be implemented as of the date of promulgation. ;
