Does the WeChat chat record have legal effect? WeChat chat records are legally binding, but to be accepted as evidence, WeChat must meet two preconditions:

(1) can prove that the users of WeChat are both parties.

If it cannot be proved that the WeChat user is a party, then the WeChat evidence has no legal connection with the incident.

There are four main ways to confirm the identity of WeChat users in current judicial practice:

1. The other party acknowledges;

2. Identification of WeChat avatar or WeChat photo album photos;

3. The real name of the network, the authentication materials of the sender of electronic data or the identity authentication of the owner;

4. The third party organization, namely Tencent, a software provider, assisted in the investigation.

Judging from the four ways mentioned above, there are many technical supports from the other party and the third party, and it is not easy to play a role by submitting enough WeChat evidence.

(2) Integrity of WeChat evidence

The integrity of WeChat evidence lies in its authenticity and relevance, because WeChat evidence is a fragmented record of life. If it is incomplete, it may be taken out of context and cannot reflect the complete true meaning of the parties.

The evidence of Article 63 of the Civil Procedure Law of People's Republic of China (PRC) includes:

(a) Statements of the parties;

(2) Documentary evidence;

(3) Physical evidence;

(4) Audio-visual materials;

(5) Electronic data;

(6) Testimony of witnesses;

(7) Appraisal opinions;

(8) Records of the inquest.

Evidence must be verified before it can be used as a basis for ascertaining facts.
