A gift contract is a contract in which the donor gives his property to the donee free of charge and the donee expresses his acceptance of the gift. Therefore, in theory, oral gift is legally binding. However, for the following two reasons, the binding force of oral gift is very low. First, oral gifts are often difficult to prove. Second, the gift contract is a practical contract, and the gift can be revoked before the ownership transfer occurs. According to the provisions of China's Civil Law, the donor can cancel the gift before the transfer of the right to donate the property, except for the gift contract with social public welfare and moral obligations such as disaster relief and poverty alleviation or the notarized gift contract. Therefore, although oral gift has legal effect, it is also easy to be revoked. In addition, if the donor clearly indicates that it will be given to a minor, it shall be deemed that the gift is valid and the gift is the personal property of the minor. If the donee accepts the gift, the gift contract shall take effect from the date when the donee accepts the gift.
