SMS is the business of telecom operators and belongs to the Ministry of Industry and Information Technology. Ministry Order No.31of the Ministry of Industry and Information Technology of the People's Republic of China-"Regulations on the Management of Communication Short Message Service" was recently promulgated, which will take effect on June 30th, 20 15. This regulation details the obligations of short message service providers, clarifies the management system and punishment measures of commercial short messages, and will provide necessary guarantee for effectively controlling spam messages, safeguarding users' legitimate rights and interests, standardizing short message service behavior and promoting the healthy development of short message service market.

At present, there are some phenomena in short message service, such as irregular operation of some service providers and spam messages. The National People's Congress Standing Committee (NPCSC)'s Decision on Strengthening Network Information Protection in 20 12 clearly stipulates that commercial electronic information shall not be sent to its fixed telephone or mobile phone without the consent or request of the receiving party. This decision provides a basic legal basis for controlling spam messages. However, there are still some specific problems such as the way users refuse to receive short messages, the obligations of short message service providers, management measures and legal responsibilities, and the governance of spam messages is also facing difficulties such as insufficient legal basis.
