Article 2 These Regulations shall apply to emergency prevention and emergency preparedness, monitoring and early warning, emergency response and rescue, post-disaster recovery and reconstruction, evaluation and examination within the administrative area of this province.
Article 3 The term "unexpected events" as mentioned in these Regulations refers to natural disasters, accidents, public health incidents and social security incidents that occur suddenly and cause or may cause serious social harm and require emergency measures.
Natural disasters, accidents and public health incidents are divided into four levels: particularly serious, major, major and general. Where laws, administrative regulations or the State Council have other provisions, such provisions shall prevail.
The grading standards for emergencies shall be implemented in accordance with the provisions of relevant departments of the State Council or the State Council.
Article 4 The emergency response should proceed from the need of strengthening and innovating social management, and implement an emergency management system with unified leadership, comprehensive coordination, classified management, graded responsibility and territorial management as the mainstay.
Article 5 People's governments at or above the county level shall formulate plans for the construction of emergency systems in their respective administrative areas, scientifically arrange key emergency construction projects, incorporate them into the national economic and social development plans, and organize their implementation.
Article 6 The people's governments at or above the county level shall be responsible for the emergency work within their respective administrative areas, and the emergency headquarters established according to law shall exercise unified leadership and comprehensively coordinate the relevant departments of the people's governments at the corresponding levels and the people's governments at lower levels to carry out emergency work; According to relevant laws, regulations and actual needs, establish relevant emergency command institutions to organize, coordinate and command relevant emergency responses. According to the needs of the development and handling of emergencies, the people's government at a higher level may send a working group to guide the people's government at a lower level or directly direct the emergency response.
Local units subordinate to higher authorities shall obey the command and dispatch of the local people's government in emergency management in accordance with the principle of territorial management.
Seventh people's governments at or above the county level shall supervise, inspect and evaluate the emergency management work of relevant departments and people's governments at lower levels; The emergency prevention and response work will be included in the annual performance appraisal scope of the main person in charge of the administrative organ and the relevant person in charge, the relevant index system of emergency management will be established, and the accountability system will be improved.
Article 8 The emergency management office of the people's government at or above the county level shall be responsible for the daily work of the emergency management of the people's government at the corresponding level, and perform the duties of emergency response, information collection, comprehensive coordination and service supervision.
The relevant departments of the people's governments at or above the county level shall, within the scope of their respective duties, do a good job in dealing with emergencies of related categories, set up emergency management offices or determine their internal organs to be specifically responsible for the emergency management of their own departments.
Relevant institutions and staff determined by township people's governments and sub-district offices are responsible for emergency management. Residents' committees and villagers' committees shall assist the people's governments in emergency management.
Relevant enterprises, institutions and private non-enterprise units shall strengthen the construction of professional emergency teams in accordance with the law, equip full-time or part-time personnel, and do a good job in emergency response.
Organs or institutions undertaking emergency management in accordance with the provisions of this article, as well as enterprises and institutions directly related to public safety, shall implement a 24-hour duty system.
Article 9 The people's governments at or above the county level and their relevant departments shall strengthen regional cooperation in emergency management, establish and improve the emergency linkage mechanism with other relevant people's governments at the same level and their relevant departments and local relevant subordinate units, strengthen information communication and resource sharing, and improve emergency response capabilities.
Article 10 People's governments at or above the county level shall establish a scientific and effective social mobilization mechanism, give full play to the role of trade unions, the Communist Youth League, women's federations, charitable organizations, the Red Cross, emergency volunteer associations and other organizations and the public in emergency response, enhance the public's awareness of public safety and social responsibility, and improve the ability of the whole society to deal with emergencies such as hedging and self-help.
Article 11 People's governments at or above the county level shall establish an emergency information disclosure system, improve the information release and spokesperson system, establish and improve the rapid response mechanism and public opinion collection and analysis mechanism for major emergency news reports, and strengthen the organization, coordination, supervision and management of information release and news reports.
No unit or individual may fabricate or disseminate false information about the development of emergencies or emergency handling.
Twelfth decisions and orders made by the people's governments at or above the county level in response to emergencies shall be reported to the Standing Committee of the people's congress at the corresponding level for the record; After the completion of the emergency response work, a special work report shall be made to the Standing Committee of the people's congress at the corresponding level. Thirteenth people's governments at or above the county level shall formulate the overall emergency plan for emergencies at the corresponding level according to law, and organize the formulation of special emergency plans for emergencies at the corresponding level; The relevant departments shall formulate their own emergency plans according to law.
Township people's governments and sub-district offices shall formulate emergency plans for emergencies in this region according to law.
Residents' committees and villagers' committees shall formulate emergency plans according to the actual situation.
Enterprises and institutions, private non-enterprise units or organizers of major events, public places and public facilities shall formulate their own emergency plans or special emergency plans according to law.
The emergency plan formulation unit shall formulate simple emergency operation procedures according to the emergency plan.
Article 14 The overall emergency plan of the people's government at a lower level shall be filed with the people's government at the next higher level; The emergency plan of the relevant departments shall be filed with the people's government at the same level and the competent department at the next higher level; Emergency plans of enterprises, institutions and private non-enterprise units directly related to public safety shall be filed with the local people's government and the competent department at the next higher level; Emergency plans of residents' committees and villagers' committees shall be filed with the local neighborhood offices and township people's governments.
The emergency plans of the people's governments at or above the county level and their relevant departments, township people's governments and sub-district offices shall be announced to the public in a timely manner in accordance with relevant regulations.
According to the actual needs and changes in the situation, the formulation unit shall timely revise and improve the emergency plan. The revised emergency plan should be re-filed.
Fifteenth people's governments at or above the county level and their relevant departments, township people's governments and sub-district offices shall formulate emergency drills and arrange emergency drills reasonably. The emergency management office of the people's government at or above the county level shall establish an index evaluation system for emergency drills to guide the emergency drills of relevant departments and people's governments at lower levels.
Enterprises, institutions and private non-enterprise units directly related to public security should carry out emergency drills at least once a year according to the actual situation.
Residents' committees and villagers' committees in emergency-prone areas shall organize residents and villagers to carry out targeted emergency drills.
Sixteenth people's governments at or above the county level shall integrate resources, unified planning and layout of key construction projects and infrastructure needed for emergency, and make overall arrangements for materials needed for emergency.
The people's governments at or above the county level shall formulate plans for the construction of emergency shelters, identify all kinds of squares, green spaces, stadiums, schools, parks, civil air defense projects and evacuation bases in cities and towns as emergency shelters, and announce their specific locations.
Emergency shelters shall set up unified and standardized signs and signs, reserve necessary materials, provide necessary medical conditions, and establish or designate isolation treatment places for patients with infectious diseases or suspected infectious diseases according to the needs of handling public health emergencies.
The owner or management unit of the emergency shelter shall strengthen the maintenance and management of the emergency shelter to ensure its normal use.
Seventeenth people's governments at or above the county level shall establish an emergency risk management system, improve the risk management system of risk identification, evaluation and control, and conduct a comprehensive risk assessment of possible emergencies; Establish the information database of hazard sources and dangerous areas, and strengthen the management of hazard sources and dangerous areas.
Eighteenth units should establish and improve the safety management system, strengthen the supervision and inspection of safety precautions, regularly carry out risk assessment, and eliminate hidden dangers in time. The following units shall also establish a safety inspection system, equipped with alarm devices and necessary emergency rescue equipment and equipment, and set warning signs in dangerous sources and dangerous areas to ensure safe operation:
(a) mines, construction units and units that produce, manage, store, transport, use and dispose of inflammable and explosive materials, dangerous chemicals, radioactive materials, pathogenic microorganisms and other dangerous goods;

Article 19 People's governments at or above the county level shall establish a public security situation analysis meeting system, and establish a social stability risk assessment mechanism with legality, rationality, feasibility and safety assessment as the main content in key areas that are easy to cause social contradictions, such as enterprise restructuring, land acquisition and demolition, education and medical care, environmental protection, safety production, food and drug safety, and conduct regular situation judgments.
County (city, district) people's governments and their relevant departments, township people's governments, neighborhood offices, residents' committees and villagers' committees shall establish a system of investigation and mediation of contradictions and disputes, determine the responsible units and responsible personnel for contradictions and disputes that may lead to social security incidents, and comprehensively use various mediation means to mediate and resolve them in time.

Article 21 People's governments at or above the county level and their relevant departments, township people's governments and sub-district offices shall regularly organize publicity and education on emergency response laws and regulations and emergency knowledge, and popularize the knowledge of emergency prevention, hedging, self-help, mutual rescue and disaster reduction.
Trade unions, the Communist Youth League, women's federations, the Red Cross and other organizations shall, according to their respective work characteristics, assist the people's government to carry out publicity and education on laws, regulations and emergency response knowledge.
Residents' committees, villagers' committees, enterprises, institutions and private non-enterprise units shall, according to the requirements of the local people's government or its dispatched organs and institutions, carry out publicity and education on emergency knowledge in light of their own reality.
Schools should incorporate emergency knowledge into the teaching content, carry out various forms of emergency knowledge education according to students' age and cognitive ability, and cultivate students' safety awareness and self-help and mutual rescue ability.
News media and telecom operators should carry out public welfare publicity of emergency prevention, early warning and emergency response, self-help and mutual rescue knowledge free of charge, and improve the public's awareness of disaster prevention and mitigation and the ability of emergency avoidance and self-help and mutual rescue.
Article 22 The people's governments at or above the county level shall establish and improve the emergency management training system, incorporate emergency management training into the training content of civil servants, determine the educational content and assessment standards of different targets, conduct regular training, and improve the ability of decision-making and handling emergencies.
Enterprises, institutions and private non-enterprise units shall train their employees in emergency response laws and regulations, safety management system, safety operation procedures and emergency knowledge, so as to enhance their awareness and ability of safety prevention.
Twenty-third people's governments at or above the county level shall establish a comprehensive emergency rescue team based on public security, fire protection and other professional teams and institutions, and be equipped with personnel and equipment in accordance with relevant requirements.
The relevant departments of the people's governments at or above the county level shall, according to actual needs, establish professional emergency rescue teams according to law; Relying on social forces to establish a professional emergency rescue team, an agreement shall be signed to clarify the rights and obligations of both parties.
Enterprises, institutions and private non-enterprise units that provide public services such as transportation, water conservancy, communication, electric power, water supply, heating, gas supply, medical care and education shall establish emergency rescue teams with their employees as the main body; Enterprises in highly dangerous industries shall set up emergency rescue teams in accordance with the relevant provisions of the state, equipped with protective equipment and equipment.
People's governments at or above the county level shall take measures to guide and support the establishment of emergency volunteer organizations and encourage them to participate in emergency knowledge publicity and education, emergency rescue and other activities. Specific measures shall be formulated by the provincial people's government.
Article 24 People's governments at or above the county level and units that set up emergency rescue teams shall strengthen the professional and vocational skills training of emergency rescue teams, buy personal accident insurance and health insurance for professional emergency rescue personnel, equip them with adequate protective equipment and devices, improve emergency rescue and safety protection capabilities, and reduce the personal injury risk of emergency rescue personnel.
Twenty-fifth people's governments at or above the county level and the relevant departments of emergency management funds and special funds included in the fiscal budget at the corresponding level; Financial reserve funds at all levels should give priority to meeting the needs of emergencies. The use of funds shall be subject to the supervision of the financial and auditing departments.
The provincial people's government shall adopt supporting policies, encourage and support institutions of higher learning and scientific and technological research and development institutions to carry out theoretical research on public safety technology, and develop new technologies, equipment and tools for emergency prevention, monitoring, early warning, emergency response and rescue.
Article 26 The province shall, in accordance with the principles of overall planning, graded responsibility, unified deployment and resource sharing, establish a three-level emergency material guarantee system at the provincial and district levels, improve the supervision, production, storage, renewal, allocation and emergency distribution system of important emergency materials, and plan provincial-level material reserves by departments and regions according to the characteristics of emergencies in different regions.
The relevant departments of the people's government at or above the county level, such as development and reform, economy and information technology, commerce and civil affairs, shall, according to their respective functions and duties, regularly organize the provision of emergency materials storage catalogues, jointly plan and build emergency materials storage warehouses with relevant departments, and adopt ways such as capacity storage, raw material product storage and logistics enterprise storage according to the needs of emergencies to ensure the production and supply of materials needed for emergency treatment and rescue.
The department responsible for emergency management of related emergencies should reserve professional emergency materials needed to deal with emergencies.
Encourage and guide enterprises and institutions, private non-enterprise units, residents' committees, villagers' committees and families to reserve basic emergency self-help materials and daily necessities.
Twenty-seventh people's governments at or above the county level and their relevant departments shall establish an emergency donation mechanism to encourage and guide all sectors of society to provide funds, material donations or technical support according to actual needs.
The use of donated funds and materials shall be announced according to law and subject to the supervision of relevant departments of the people's government, donors and society.
Article 28 The people's governments at or above the county level shall, in accordance with the principles of overall planning, careful connection, standardization and integration of resources, fully integrate and utilize the existing professional system resources, and build the emergency platform system of provinces, autonomous regions, cities and counties (cities, districts) to realize interconnection, information sharing and avoid repeated construction.
The provincial government emergency platform system undertakes the functions of monitoring, forecasting and early warning, information submission, comprehensive judgment, auxiliary decision-making, command and dispatch, consultation in different places, information release, post-evaluation and so on. Article 29 People's governments at or above the county level shall establish a unified emergency information collection and submission system, and organize people's governments at lower levels, relevant departments and professional monitoring institutions, as well as residents' committees, villagers' committees, news media and other units to collect and submit emergency information and related social dynamics.
The contents of the emergency report shall include the time, place, unit name, contact information, information source and event category, preliminary assessment of casualties and economic losses, scope of influence, development trend and disposal.
The people's government at the county level shall establish an emergency information reporter system, and may employ journalists, police and other relevant grassroots organizations as reporters.
The people's governments at or above the county level and their relevant departments, Township People's governments and sub-district offices shall report the emergency information step by step, and if necessary, they may report it leapfrog.
Thirtieth emergency information submitted shall comply with the following provisions:
(a) timely, objective, true and accurate, and shall not be late, false, concealed or omitted;
(two) to report the information of social security incidents that may have a significant impact or occur in key areas and special time periods immediately;
(three) involving state secrets, keep state secrets.
The submitting unit shall report the progress of emergency response in a timely manner until the end of emergency response and make a summary report.
Thirty-first people's governments at or above the county level and their relevant departments shall, according to their respective responsibilities, establish and improve professional monitoring institutions and improve the emergency monitoring and early warning system. Relevant professional monitoring institutions shall strengthen technical support construction according to emergency needs to ensure the integrity and reliability of monitoring data and information.
The early warning levels of natural disasters, accident disasters and public health events that can be forewarned are divided into level 1, level 2, level 3 and level 4 according to the urgency, development trend and possible harm degree of emergencies, of which level 1 is the highest level, which is represented by red, orange, yellow and blue respectively.
Article 32 When an emergency that can be forewarned is about to occur or the possibility of occurrence increases, the people's government at or above the county level shall publicly issue an alarm at the corresponding level to the society according to law, decide and declare the relevant area to enter the early warning period, and report to the people's government at the next higher level; When necessary, it may report to the local garrison and the neighboring or relevant people's governments at or above the county level that may be endangered.
Thirty-third early warning information shall be issued by the people's governments at or above the county level or the authorized relevant departments in accordance with the relevant provisions of the state. The contents released include the categories of emergencies, early warning levels, possible influence scope, early warning items, measures to be taken and release authorities.
Early warning information can be released through radio, television, newspapers, internet, Weibo, short messages, air defense alarms, electronic display screens, cable broadcasts, publicity vehicles and leaflets.
Citizens, legal persons and other organizations shall cooperate with local people's governments and relevant departments to deal with emergencies after receiving early warning information.
Thirty-fourth people's governments or their authorized departments shall, according to the development of the situation, timely adjust the early warning level or update the early warning information in accordance with relevant regulations, and re-issue.
If it is proved by facts that an emergency cannot occur or the danger has been lifted, the people's government at or above the county level or its authorized department shall immediately announce the lifting of the early warning, terminate the early warning period and lift the relevant measures already taken. Thirty-fifth natural disasters, accidents or public health incidents, the people's governments at or above the county level shall command and coordinate emergency response in accordance with the following provisions:
(a) general emergencies, the county (city, district) people's government and its relevant departments responsible for emergency disposal, when necessary, by the relevant categories of emergency command institutions to guide the disposal;
(two) major emergencies, by the Municipal People's government and its relevant departments responsible for emergency disposal, when necessary, by the relevant provincial emergency command institutions to guide the disposal;
(three) major emergencies, the provincial people's government is responsible for emergency disposal, and the relevant emergency command institutions in the province are specifically responsible;
(four) especially serious emergencies, reported to the State Council for emergency treatment or according to the deployment of the State Council by the provincial people's government for emergency treatment.
If the people's government at a lower level cannot effectively control emergencies or eliminate the serious social harm caused by emergencies, it shall promptly report to the people's government at a higher level for unified leadership in handling emergencies.
Article 36 After an emergency occurs, the people's government that performs unified leadership duties or organizes the handling of emergencies may take one or more of the following measures in addition to the emergency handling measures stipulated in Articles 49 and 50 of the Emergency Response Law of People's Republic of China (PRC):
(1) Providing emergency shelters and daily necessities for threatened persons, and implementing safeguard measures such as medical rescue, disease prevention and control, and psychological intervention services;
(two) according to the needs of emergency response, mobilize rescue forces and reserve materials, requisition equipment, facilities, venues, vehicles and other materials needed for emergency rescue from relevant units and individuals, and designate rescue units and emergency shelters;
(three) to guide the relevant enterprises to organize the production and supply of daily necessities and emergency relief materials;
(four) to coordinate the transportation management units to give priority to the transportation of people who are harmed by emergencies and the rescue personnel and materials needed to deal with emergencies;
(five) report to the people's government at a higher level or request the people's government at a lower level to provide manpower, material resources, financial resources or technical support for emergency response.
Citizens, legal persons and other organizations shall obey the decisions, orders, commands and arrangements of the people's government and actively cooperate with the implementation of emergency measures.
Thirty-seventh people's governments that perform unified leadership duties or organize the handling of emergencies shall, in accordance with relevant regulations, uniformly, accurately and timely release information on the development of emergencies and emergency response.
Thirty-eighth provincial people's government should establish and improve the comprehensive coordination mechanism of emergency traffic in the province.
During the handling of emergencies, emergency vehicles equipped with emergency signs uniformly issued by the provincial people's government can have priority access and be free of vehicle tolls; After the threats and hazards of emergencies are controlled or eliminated, the publishing agency shall promptly recover the emergency signs.
Thirty-ninth emergency command institutions at all levels and relevant emergency command institutions shall establish and improve the expert consultation system, set up emergency management expert groups according to the needs, provide analysis, evaluation, decision-making consultation and suggestions for emergency disposal, and absorb them to participate in the disposal work when necessary.
Fortieth communication management departments shall organize and supervise telecom operators to ensure the smooth flow of emergency communication systems; Radio and television, press and publication, network management and other departments shall organize and coordinate the news media, provide information broadcast for emergency response, and implement supervision according to law.
Forty-first people's governments at or above the county level shall, when implementing emergency requisition according to law, issue an emergency disposal requisition notice to the requisitioned unit or individual in advance and register it. The requisition notice for emergency disposal shall include the name, address, contact information, name of the person subjected to execution, purpose and time of requisition, name, quantity and model of the requisitioned property. When the situation is particularly urgent, it can be requisitioned in advance according to law and go through the formalities afterwards.
After the expropriated property is exhausted, the people's government that implements the expropriation shall return the expropriated person in time; If the property is expropriated or damaged after expropriation, it shall be compensated according to law.
Units and individuals take the initiative to provide property to deal with emergencies, the use of units should be registered, after the completion of emergency disposal, timely return; If it works and suffers damage, it shall be compensated with reference to the provisions of the preceding paragraph.
Forty-second disposal of emergencies, the need for government procurement, the people's governments at or above the county level and their financial departments should simplify the procedures for examination and approval of financial funds and disbursement, to ensure the funds needed for emergency disposal. Article 43 After the threats and hazards of emergencies are controlled or eliminated, the people's governments that perform unified leadership duties or organize the handling of emergencies shall promptly announce the end of emergency handling, stop the implementation of emergency handling measures, and at the same time take or continue to implement necessary measures to prevent the occurrence of secondary and derivative events such as natural disasters, accidental disasters and public health incidents or re-trigger social security incidents.
Article 44 After the emergency treatment is completed, people's governments in areas affected by emergencies should organize forces to restore social order, repair damaged public facilities such as transportation, communication, water supply, drainage, power supply, oil supply, gas supply, heating, radio and television as soon as possible, timely organize the allocation of relief materials and daily necessities, ensure the basic livelihood of residents, and restore the order of production, life, study and work as soon as possible.
Public security organs should strengthen public security management according to the actual situation, prevent and stop all kinds of illegal and criminal activities, and maintain social order and stability.
Forty-fifth people's governments in areas affected by emergencies shall, in accordance with state regulations and the principle of fairness and reasonableness, compensate citizens, legal persons and other organizations for property losses caused by taking measures to deal with emergencies.
Forty-sixth people's governments in areas affected by emergencies should formulate recovery and reconstruction plans and rehabilitation work plans, and do a good job in recovery and reconstruction in accordance with the principle of combining government leadership, social participation and market operation.
Article 47 The people's governments at higher levels in areas affected by emergencies shall, in accordance with the relevant provisions of the state, formulate policies to support areas or industries affected by emergencies, give tax relief, loan interest subsidies, financial transfer payments, material, human and technical support and other support according to law, and mobilize social forces to carry out charitable donation activities.
Forty-eighth people's governments at or above the county level in areas affected by emergencies and their relevant departments shall, in conjunction with the insurance supervision and administration institutions, urge insurance companies to do a good job in emergency insurance claims.
Forty-ninth citizens to participate in emergency rescue work or help maintain social order, their wages and welfare benefits remain unchanged; Without a work unit, the people's government of the county (city, district) where the emergency occurred shall give appropriate subsidies.
The people's governments at or above the county level shall, in accordance with the relevant provisions of the state, commend or reward units and individuals that have made outstanding achievements in emergency response.
The people's governments at or above the county level shall give pensions to the casualties in emergency rescue work according to law.
Article 50 The people's governments at or above the county level in the places where emergencies occur and the affected areas shall, in accordance with relevant regulations, organize investigations and assessments on the causes, nature, process and consequences of emergencies, conduct retrospective investigations on prevention and emergency preparedness, monitoring and early warning, emergency response and rescue, and form emergency response reports, which shall be submitted to the people's government at the next higher level. Fifty-first acts in violation of these regulations, "People's Republic of China (PRC) Emergency Response Law" and other relevant laws and regulations, in accordance with its provisions.
Fifty-second administrative organs and their staff in violation of these regulations, do not perform or improperly perform their statutory duties, shall be ordered by their superior administrative organs or supervisory organs to make corrections; Under any of the following circumstances, the directly responsible person in charge and other directly responsible personnel shall be punished according to the circumstances:
(1) Failing to implement the 24-hour duty system;
(two) the emergency plan has not been formulated or filed;
(three) the emergency shelter has not been determined or announced to the public;
(4) Failing to conduct investigation, registration, dynamic management, regular inspection and monitoring of dangerous sources and dangerous areas;
(5) Failing to establish an emergency rescue team or organizing emergency publicity training and emergency drills;
(six) failing to report emergency information in accordance with the provisions;
(seven) did not adjust the warning level, release or update the warning information, or did not lift the alarm in accordance with the provisions;
(eight) not timely pretreatment or improper treatment;
(nine) emergency requisition is not carried out in accordance with legal procedures;
(ten) other circumstances that should be punished. Article 53 When emergencies occur in other provinces, autonomous regions and municipalities directly under the Central Government, the people's governments at the provincial level shall make unified arrangements and organize participation in emergency rescue and post-disaster recovery and reconstruction according to the requirements of the State Council or actual needs.
