Measures for the Registration of Computer Software Copyright Chapter I General Provisions Article 1 These Measures are formulated for the implementation of the Regulations on the Protection of Computer Software (hereinafter referred to as the Regulations). Article 2 In order to promote the development of China's software industry and enhance the innovation ability and competitiveness of China's information industry, the state copyright administration department encourages software registration and gives priority protection to registered software. Article 3 These Measures shall apply to the registration of software copyright, the exclusive license contract of software copyright and the registration of transfer contract. Article 4 The applicant for software copyright registration shall be the software copyright owner and the natural person, legal person or other organization that inherits, transfers or accepts the software copyright. The applicant for the registration of software copyright contract shall be the party to the exclusive license contract or transfer contract of software copyright. Article 5 Where the applicant or one of the applicants is a foreigner or a stateless person, these Measures shall apply. Article 6 The National Copyright Administration is in charge of the administration of software copyright registration throughout the country. The National Copyright Administration recognized China Copyright Protection Center as the software registration agency. With the approval of the National Copyright Administration, China Copyright Protection Center may set up local software registration offices. Chapter II Application for Registration Article 7 The software applied for registration shall be independently developed or modified with the permission of the original copyright owner, and its function or performance shall be greatly improved. Article 8 When registering the copyright of the software jointly developed, the copyright owner may determine a copyright owner as his representative through consultation. If the copyright owners cannot reach an agreement through consultation, any copyright owner may apply for registration without harming the interests of other copyright owners, but the other copyright owners shall be indicated. Article 9 To apply for software copyright registration, the following materials shall be submitted to China Copyright Protection Center: (1) An application form for software copyright registration filled out as required; (2) Identification materials of the software; (3) Relevant supporting documents. Article 10 Software authentication materials include program authentication materials and document authentication materials. The identification materials of programs and files shall consist of 30 consecutive pages before and after the source program and any kind of files. If the whole program and document are less than 60 pages, the whole source program and document should be submitted. Except in special circumstances, the program has no less than 50 lines per page and the document has no less than 30 lines per page. Article 11 To apply for software copyright registration, the following main supporting documents shall be submitted: (1) the identity certificate of a natural person, legal person or other organization; (2) If there is a written contract or project transfer for copyright ownership, submit the contract or project transfer; (3) Software developed on the original software with the permission of the original software copyright owner shall submit the license certificate of the original software copyright owner; (four) the successor, assignee or assignee of the right, and submit the certificate of inheritance, transfer or assignment of the right. Article 12 When applying for the registration of software copyright, you can choose one of the following methods as an exception for the registration of authentication materials: (1) There are 30 consecutive pages before and after the source program, in which the confidential part is covered with black diagonal lines, but the covered part shall not exceed 50% of the registered source program; (2) The first 10 page of the source program, plus 50 pages of any part of the source program; (3) There are 30 consecutive pages before and after the target program, plus 20 consecutive pages in any part of the source program. Where documents are stored as an exception, it shall be handled with reference to the provisions of the preceding paragraph. Thirteenth software copyright registration, the applicant may apply for the source program, documents or samples sealed. No one can unseal the seal except the applicant or the judicial organ. Article 14 The parties to a software copyright transfer contract or an exclusive license contract may apply to China Copyright Protection Center for contract registration. When applying for contract registration, the following materials shall be submitted: (1) a contract registration form filled out as required; (2) A copy of the contract; (3) the identity certificate of the applicant. Article 15 An applicant may request to withdraw his application at any time before the application for registration is approved. Article 16 A software copyright registrant or a contract registrant may change or supplement the registered items. When applying for change or supplementary registration, the applicant shall submit the following materials: (1) an application form for change or supplementary registration; (2) Registration certificate or a copy of the certificate; (3) Materials related to changes or supplements. Article 17 The application for registration shall use the unified format formulated by China Copyright Protection Center, and shall be stamped (signed) by the applicant. The application form should be filled in Chinese. If the certificates and supporting documents submitted are in foreign languages, Chinese versions shall be attached. The documents applying for registration shall be A4 paper of international standard of 297mm× ×2 10/0mm (length× width). Article 18 Application documents can be submitted directly or sent by registered mail. When submitting the relevant application documents, the applicant shall indicate the name of the applicant and the software, and the acceptance number or registration number, if any, shall be indicated. Chapter III Examination and approval Article 19 The application referred to in Articles 9 and 14 of these Measures shall be accepted on the date of receipt of the materials conforming to the provisions of Chapter II of these Measures, and the applicant shall be notified in writing. Twentieth China Copyright Protection Center shall complete the examination of the accepted application within 60 days from the date of acceptance. If the application complies with these regulations and the laws and regulations of this bureau, it shall be registered, issued with the corresponding registration certificate and announced. Article 21 In any of the following circumstances, registration shall not be granted, and the applicant shall be notified in writing: (1) The contents of the form are incomplete and irregular, and have not been corrected within the prescribed time limit; (2) The appraisal materials submitted are not software programs and documents stipulated in the Regulations; (3) The name of the software appearing in the application documents is inconsistent with the signature of the obligee, and no supporting documents have been submitted; (4) The ownership of the software applied for registration is disputed. Twenty-second China Copyright Protection Center requires the applicant to make corrections to other registration materials, and the applicant shall make corrections within 30 days. If no correction is made within the time limit, the application shall be deemed to have been withdrawn. Article 23 In any of the following circumstances, the National Copyright Administration may cancel its registration: (1) The judicial judgment is final; (two) the administrative punishment decision made by the copyright administrative department. Article 24 China Copyright Protection Center may cancel its registration upon the application of the applicant. Twenty-fifth registration certificate is lost or damaged, you can apply for a replacement or renewal. Chapter IV Software Registration Announcement Article 26 Unless otherwise stipulated in these Measures, anyone may consult the software registration announcement and related public registration documents. Article 27 The contents of the software registration announcement are as follows: (1) Software copyright registration; (2) Registration of software copyright contracts; (3) Cancellation of software registration; (4) Other matters. Chapter V Fees Article 28 When applying for software registration or handling other matters, the following fees shall be paid: (1) software copyright registration fee; (2) Registration fee for software copyright contract; (three) change or supplement the registration fee; (4) registration certificate fee; (5) storage fees; (6) Abnormal deposit fee; (7) Inquiry fee; (eight) the application fee for cancellation of registration; (9) Other expenses payable. The specific charging standards shall be formulated and published by the National Copyright Administration in conjunction with the competent price department of the State Council. Twenty-ninth applicants voluntarily withdraw their applications or the registration authority refuses to register, and the fees paid will not be refunded. Thirtieth the fees stipulated in Article 28 of these Measures can be remitted through the post office or bank, or directly paid to China Copyright Protection Center. Chapter VI Supplementary Provisions Article 31 The time limits specified in these Measures and designated by China Copyright Protection Center shall not be counted on the first day. If calculated in years or months, the expiration date shall be the corresponding day of the last month; If there is no corresponding day in the current month, the last day of the current month shall be the due date. If the due date is a legal holiday, the first working day after the holiday shall be the due date. Article 32 All documents mailed by the applicant to China Copyright Protection Center shall be submitted on the postmark date. If the postmark date sent on the envelope is unclear, the date of receipt shall be the date of submission, unless the applicant provides proof. All kinds of documents mailed by China Copyright Protection Center are delivered to provincial capitals, autonomous regional capitals and municipalities directly under the Central Government, and are presumed to be received by the recipients within 15 days from the date of issuance, and within 2 1 day in other regions. Article 33 Where the applicant delays the time limit stipulated in these Measures or specified by China Copyright Protection Center due to force majeure or other legitimate reasons, he may request an extension of the time limit within 30 days after the obstacle is removed. Article 34 These Measures shall be interpreted, supplemented and revised by the National Copyright Administration. Article 35 These Measures shall be implemented as of the date of promulgation.
