What is the use of the national anti-fraud center?

The National Anti-Fraud Center is a synthetic operational platform for the the State Council Inter-Ministerial Joint Conference on Combating and Governing New Crimes in Telecommunication Networks. It integrates resource integration, intelligence research and investigation and command, and plays an important role in cracking down on and preventing new illegal crimes such as telecommunication network fraud.

The anti-fraud center can stop the loss urgently, but whether it can recover the cheated money depends on whether the fraudster has spent all the cheated money. Usually, the police will find and arrest suspects who violate the law or commit crimes, which increases the possibility that victims can get their legal property back. If the victim suffers material losses due to the defendant's criminal behavior, he has the right to file an incidental civil action in the course of criminal proceedings.

The establishment of anti-fraud center, its main purpose is to release anti-fraud knowledge, do anti-fraud propaganda, and combat telecom fraud. When we receive a fraudulent phone call, the National Anti-Fraud Center will issue an early warning and inform us. When we don't answer the early warning call, we will also arrange for the police to visit us to prevent being deceived. According to Article 8 of the Notice on Preventing and Combating the Crime of Telecommunication Network Fraud, all localities and departments should intensify their propaganda, carry out extensive publicity and reports, and form a strong public opinion momentum. It is necessary to make use of various media channels to promptly release early warning tips on telecommunication network crimes to the public, popularize legal knowledge, and improve the public's ability to identify various telecommunication network frauds and safety awareness.

Legal basis:

Article 266 of the Criminal Law of People's Republic of China (PRC) stipulates that whoever defrauds public or private property in a relatively large amount shall be sentenced to fixed-term imprisonment of not more than three years, criminal detention or public surveillance, and shall also or only be fined; If the amount is huge or there are other serious circumstances, he shall be sentenced to fixed-term imprisonment of not less than three years but not more than ten years and shall also be fined; If the amount is especially huge or there are other especially serious circumstances, he shall be sentenced to fixed-term imprisonment of not less than 10 years or life imprisonment, and shall also be fined or confiscated. Where there are other provisions in this Law, such provisions shall prevail.
