Notice of Shaanxi Provincial Department of Finance on Further Standardizing the Relevant Matters of Government Procurement Information Disclosure

All districts and cities, Yangling Demonstration Zone, hancheng city Finance Bureau, provincial departments and units, and government procurement agencies:

In order to thoroughly implement the spirit of deepening the reform of government procurement system, optimize the business environment of government procurement, enhance the transparency of government procurement in our province, and solve the problems existing in the evaluation of government procurement transparency in our province, the relevant matters concerning further standardizing the disclosure of government procurement information in our province are hereby notified as follows:

First, the scope and subject of government procurement information disclosure

(1) Announcement and publicity information. Government procurement announcement and publicity information mainly include government procurement intention disclosure, single-source procurement announcement, tender announcement, prequalification announcement, competitive negotiation (competitive negotiation and inquiry) announcement, correction announcement, bid-winning (transaction) result announcement, contract announcement, performance acceptance information, electronic store transaction information and the implementation of reserved shares of small and medium-sized enterprises. The subject of publication is the purchaser or its entrusted procurement agency, and if the procurement agency is entrusted to publish, the purchaser shall specify it in the agency agreement.

(2) Supervision and inspection information. Government procurement supervision and supervision and inspection information mainly includes complaint handling, administrative punishment, announcement of supervision and inspection results, assessment results of centralized procurement institutions, and records of major illegal and untrustworthy behaviors made by financial departments at all levels. And the main body of the release is the financial departments at all levels.

Two, the implementation of the main responsibility of government procurement information release

(1) Strict information release format. The government procurement information released by each publishing unit in the designated media shall conform to the format stipulated in the Notice on Printing and Distributing (No.50 [2020] of the Finance Office), and the disclosure period and contents shall conform to the requirements of relevant laws, regulations and rules and regulations on government procurement.

(2) Ensure that the release time is consistent. Publishers need to publish government procurement information in other non-designated media, and should ensure that the contents of the same government procurement information published in different media are consistent; If the content and time of the same government procurement information published in different media are inconsistent, the information published by Shaanxi Provincial Government Procurement Network shall prevail.

(3) Strengthen the management of information release. Each publishing unit shall incorporate the disclosure of government procurement information into the management of its internal control system, assume the main responsibility for the authenticity, accuracy, timeliness and legality of the information disclosed by the unit, clarify the post responsibilities and authority, and shall not publish information unrelated to government procurement on the government procurement website of Shaanxi Province, and shall not publish other information involving state secrets, commercial secrets, personal privacy and other information that is not disclosed according to law.

Three, strengthen the release time of government procurement information.

(a) the purchaser or its entrusted agency shall, in strict accordance with the requirements of the government procurement time limit, timely disclose the government procurement intention, single-source publicity, procurement documents, suppliers recommended by the purchaser and the opinions of evaluation experts. Pay attention to the publicity of government procurement contracts. The purchaser shall upload the scanned version of the contract through the Shaanxi provincial government procurement website within 2 working days from the date of signing the contract, and truthfully fill in the time of signing the contract. Since 2022, before the end of April every year, the implementation of the reserved share of small and medium-sized enterprises in Shaanxi Province will be made public on the government procurement website.

(2) The announcement of the decision on handling complaints, supervision and inspection made by the financial departments at all levels shall be made within 5 working days after the relevant reporting procedures are completed and fulfilled. When the government procurement agency announces the procurement results, the procurement documents shall be announced at the same time as the winning bid (transaction) results. If the procurement documents have been announced before winning the bid (transaction), the announcement will not be repeated.

Fourth, the job requirements

(a) to effectively improve the understanding of the importance of government procurement information disclosure. The disclosure of government procurement information is the main content of the transparency evaluation of government procurement commissioned by the Ministry of Finance. All units should attach great importance to it, raise awareness, implement responsibilities, and conscientiously do a good job in the disclosure of government procurement information in accordance with relevant requirements. According to the requirements of government procurement information disclosure and the evaluation index of government procurement transparency, the government procurement information that has been disclosed in the past two years will be comprehensively sorted out and self-examined, and the problems found will be rectified in time. It is necessary to establish and improve the internal control system of government procurement information disclosure to ensure the whole process of government procurement information disclosure.

(2) Strengthen the supervision and management of information disclosure. Financial departments at all levels should, in accordance with the relevant provisions of government procurement laws and regulations, strengthen supervision and inspection of the disclosure of government procurement information of budget units and procurement agencies at the corresponding level, urge budget units and procurement agencies to carry out self-inspection of government procurement information disclosure, deal with the problems found in supervision and inspection according to law, and disclose the results according to law.

(3) Establish an interview mechanism for problem rectification. The Provincial Department of Finance will establish an interview mechanism for the rectification of government procurement information disclosure and the evaluation results of government procurement transparency. According to the results of the third-party evaluation of the transparency of government procurement in that year, the cities (districts) and units with outstanding problems in the disclosure of government procurement information were interviewed, and the relevant responsible parties were urged to make rectification.
