Article 175 of the "Regulations on the Procedures for Handling Criminal Cases by Public Security Organs": After the public security organ accepts the case and upon review, it is deemed that there are criminal facts that require criminal liability and that it falls within its own jurisdiction, it shall be subject to the approval of the person in charge of the public security organ at or above the county level. The case shall be filed; if it is considered that there are no criminal facts, or the criminal facts are obviously minor and do not require criminal liability, or there are other circumstances that do not require criminal liability according to law, the case shall not be filed with the approval of the person in charge of the public security organ at or above the county level. If a case with an accuser decides not to file the case, the public security organ shall prepare a notice of disapproval and serve it to the accuser within three days. Article 179: For a case where the People's Procuratorate requires an explanation of the reasons for not filing the case, the public security organ shall, within seven days after receiving the notice, provide a written explanation of the circumstances, basis and reasons for not filing the case and reply to the People's Procuratorate. If the public security organ makes a decision to file a case, it shall send a copy of the decision to file the case to the People's Procuratorate. If the People's Procuratorate notifies the public security organ to file a case, the public security organ shall file the case within fifteen days after receiving the notice and send a copy of the decision to file the case to the People's Procuratorate
