Does the leave company not approve the violation?

Legal analysis: whether to approve or not is not arbitrary. At present, there is no mandatory provision on personal leave in China's laws, and matters related to personal leave belong to the scope of internal management of enterprises and autonomy of will between enterprises and employees. Therefore, whether employees can take personal leave or not depends on whether there are provisions on "personal leave" in the internal rules and regulations of the enterprise and the employee's labor contract.

If the enterprise's supervision system has a perfect approval process, conditions and days for personal leave, and the employee's labor contract also states that the employee has the right to take a few days off, then the enterprise should strictly abide by these systems and contractual agreements.

Legal basis: Article 45 of the Labor Law of People's Republic of China (PRC). The state practices the system of paid annual leave. Workers who have worked continuously for more than one year are entitled to paid annual leave.
