Process for applying for property maintenance fund

Legal analysis: If an owners committee has been established at the time of application, the owners committee shall serve as the reporting body to apply for application procedures for the use of maintenance funds. When applying, it is necessary to provide the signatures of more than 2/3 of the owners and the maintenance budget; if there is no owners committee, property management has been implemented or there is a housing management unit, the property service company or housing management unit can be the entrusted applicant unit to apply for the use of maintenance funds. Procedures; if there is no owners committee, no property management, and no housing management unit, the community in the jurisdiction will be the applicant to handle the application procedures for the use of maintenance funds. Application materials for the housing repair fund must be submitted to the Municipal Housing Security and Real Estate Administration Bureau for review by staff. The amount of public facility maintenance costs that apply for the housing maintenance fund cannot be too small, and the owners who apply must at least be units or buildings, not just individual residents.

Legal basis: Article 22 of the "Regulations on the Management of Special Residential Maintenance Funds of the People's Republic of China" The following procedures are followed:

(1) The property service company shall put forward usage suggestions based on the maintenance, renewal and renovation projects; if there is no property service company, the relevant owners shall put forward usage suggestions;

(2) ) Owners whose exclusive portion accounts for more than two-thirds of the total area of ??the building and more than two-thirds of the total number of owners within the scope of special residential maintenance funds have discussed and approved use suggestions;

(Three ) The property service enterprise or relevant owners organize the implementation of the usage plan;

(4) The property service enterprise or relevant owners shall submit relevant materials to the construction (real estate) competent department of the local municipality, city or county people's government to apply for expenditures ; Among them, if the special maintenance funds for public housing are used, an application should be made to the department responsible for managing the special maintenance funds for public housing;

(5) Construction (real estate) authorities of the municipal, city, and county people's governments Or, after review and approval, the department responsible for managing special housing maintenance funds for public housing will issue a notice to the special account management bank to transfer the special housing maintenance funds;

(6) The special account management bank will transfer the required special housing maintenance funds to the special account management bank. The funds are transferred to the maintenance unit.
