How long does it usually take to get a food license?

Generally, you can apply for a food license within 10 working days. The local food and drug supervision and administration department at or above the county level shall, according to the examination of the application materials and on-site verification, make a decision on granting the business license to those who meet the requirements, and issue the food business license to the applicant within 10 working days from the date of making the decision; If it does not meet the requirements, it shall promptly make a written decision not to grant permission and explain the reasons, and inform the applicant of the right to apply for administrative reconsideration or bring an administrative lawsuit according to law.

How to get a food license?

Under normal circumstances, the food business license can be completed within 20 working days. After making the decision to approve the business license, the food business license shall be issued to the applicant within 10 working days from the date of making the decision. The procedures for applying for a food business license are as follows:

1. Fill in the food business license application form and submit relevant materials;

2. Submit relevant materials, and wait for the approval result after receiving the certificate of material receipt or acceptance notice.

3. Obtain a food business license. You can get a food license in 40 days.

The conditions for applying for a food license are as follows:

1. It has food raw material processing, processing, sales and storage places suitable for the variety and quantity of food it deals in, keeping the environment of the places clean and tidy, and keeping a prescribed distance from toxic and harmful places and other pollution sources;

2. There are business equipment or facilities suitable for the variety and quantity of food to be operated, and there are corresponding equipment or facilities for disinfection, changing clothes, washing, lighting, ventilation, corrosion prevention, dust prevention, fly prevention, rodent prevention, insect prevention, washing, wastewater treatment and garbage storage;

3, full-time or part-time food safety management personnel and rules and regulations to ensure food safety;

4. Have a reasonable equipment layout and technological process to prevent cross-contamination of food to be processed and directly imported food, raw materials and finished products, and avoid food contact with toxic and unclean substances;

5. Other conditions stipulated by laws and regulations.

Article 122

Anyone who, in violation of the provisions of this Law, engages in food production and marketing activities without obtaining a food production and marketing license, or engages in food additive production activities without obtaining a food additive production license, the food safety supervision and administration department of the people's government at or above the county level shall confiscate the illegal income, illegally produced and marketed food, food additives and tools, equipment, raw materials and other articles used for illegal production and marketing; If the value of food and food additives illegally produced and operated is less than 1 10,000 yuan, a fine of more than 50,000 yuan110,000 yuan will be imposed; If the value of goods is more than 1 10,000 yuan, a fine of more than 10 and less than 20 times shall be imposed.

Knowing that it is an illegal act stipulated in the preceding paragraph, but still providing production and business premises or other conditions, the food safety supervision and administration department of the people's government at or above the county level shall order it to stop the illegal act, confiscate its illegal income and impose a fine of not less than 50,000 yuan but not more than 100,000 yuan; Those who harm the legitimate rights and interests of consumers shall be jointly and severally liable with the producers and operators of food and food additives.
