The Interpretation on Several Issues Concerning the Specific Application of Laws in Handling Criminal Cases of Preventing and Controlling Outbreaks of Infectious Diseases stipulates that those who intentionally spread pathogens of sudden infectious diseases and endanger public safety shall be convicted of endangering public safety by dangerous methods in accordance with the provisions of Article 114 and Article 115, paragraph 1, of the Criminal Law, and those who have not caused serious consequences shall be sentenced to fixed-term imprisonment of not less than three years but not more than ten years; Whoever causes serious injury or death to others or heavy losses to public or private property shall be sentenced to fixed-term imprisonment of not less than 10 years, life imprisonment or death.

Those who suffer from sudden infectious diseases or suspected sudden infectious diseases, refuse to accept quarantine, compulsory isolation or treatment, and cause the spread of infectious diseases through negligence, if the circumstances are serious and endanger public safety, shall be convicted of the crime of endangering public safety by dangerous means through negligence in accordance with the provisions of the second paragraph of Article 115 of the Criminal Law, and shall be sentenced to fixed-term imprisonment of not less than three years but not more than seven years; If the circumstances are minor, they shall be sentenced to fixed-term imprisonment of not more than three years or criminal detention.
