Rights should be safeguarded during arbitration. After receiving the notice, you should actively appear in court to negotiate with the other party. If an agreement is reached with the other party, the award may be executed. If one party fails to perform, the other party may apply to the people's court for execution in accordance with the relevant provisions of the Civil Procedure Law. If both parties fail to reach an agreement, an arbitration tribunal may be established for arbitration.

Article 62 stipulates that both parties shall perform the award. If one party fails to perform, the other party may apply to the people's court for execution in accordance with the relevant provisions of the Civil Procedure Law. The people's court to which the application is made shall execute it.

If the respondent provides evidence to prove that the award is under any of the circumstances stipulated in Article 274 of the Civil Procedure Law, the people's court shall form a collegial panel for examination and verification, and decide not to execute it.

Article 274 Non-execution

If the respondent provides evidence to prove that the arbitral award made by the People's Republic of China (PRC) foreign-related arbitration institution is under any of the following circumstances, the people's court shall form a collegial panel for examination and verification, and make a ruling not to execute it:

(a) the parties have no arbitration clause in the contract or have not reached a written arbitration agreement afterwards;

(2) The respondent has not been informed of the appointment of arbitrators or the arbitration proceedings, or has not stated his opinions for other reasons that are not the responsibility of the respondent;

(3) The composition of the arbitration tribunal or the arbitration procedure does not conform to the arbitration rules; (four) the matters decided are not within the scope of the arbitration agreement or the arbitration institution has no right to arbitrate. If the people's court finds that the execution of the ruling is contrary to the public interest, it shall rule not to execute it.
