1. People's Republic of China (PRC) Coal Law (Decree No.75 of the President of the People's Republic of China1August 29, 1996), Chapter IV, Article 48: To establish a coal trading enterprise, an application must be submitted to the department designated by the State Council or the department designated by the people's governments of provinces, autonomous regions and municipalities directly under the Central Government; The departments designated by the State Council or the people's governments of provinces, autonomous regions and municipalities directly under the Central Government shall conduct qualification examination in accordance with the conditions stipulated in Article 47 of this Law and the hierarchical management authority stipulated in the State Council; Those that meet the requirements shall be approved. The applicant may engage in coal business only after applying to the administrative department for industry and commerce for a business license with the approval documents.

2. Article 5 of the Measures for the Supervision of Coal Business (Order No.25 of the Development and Reform Commission of the People's Republic of China, 2004, 65438+February 27): The state implements the examination system for coal business qualifications. The establishment of a coal trading enterprise shall be subject to the qualification examination of coal business.

Article 6 Coal business qualifications shall be examined and managed at different levels. The National Development and Reform Commission is responsible for the qualification examination of coal trading enterprises registered by the State Administration for Industry and Commerce. The coal business qualification examination departments designated by the people's governments of provinces, autonomous regions and municipalities directly under the Central Government shall be responsible for the coal business qualification examination within their respective administrative areas.

Application conditions:

(1) It has a corresponding business scale: the annual business volume of coal wholesale enterprises is over 50,000 tons, and the annual business volume of coal retail and briquette processing enterprises is over 1 10,000 tons;

(2) It has a registered capital commensurate with its business scale, with a coal wholesale enterprise of not less than 5 million yuan, a coal retail enterprise of not less than 2 million yuan, and a civil briquette processing enterprise of not less than/kloc-0.0 million yuan;

(3) Having a fixed business place (office place);

(4) Having facilities and coal storage sites suitable for the scale of operation, with a coal wholesale enterprise not less than 3,000 square meters, a coal retail enterprise not less than 1. 500 square meters, and a civil briquette processing enterprise not less than 1. 000 square meters;

(5) Having coal metering and quality inspection equipment that meets the standards;

(six) in line with the national requirements for the rational distribution, total control and environmental protection of coal trading enterprises;

(seven) other conditions stipulated by laws and administrative regulations;

Licensing procedures:

(1) application

After the applicant meets the application conditions, prepare the application materials, and then submit them to the preliminary examination departments of coal business qualifications in prefecture-level cities.

(2) Accept

The preliminary examination department shall inform whether the application can be accepted under the premise of satisfying the reasonable layout and total control. If it is accepted, it shall inform the applicant of all the contents that need to be corrected at one time within five working days from the date of receiving the application materials. Fails to inform, as accepted.

(3) Review

After acceptance, the application materials shall be preliminarily examined according to law within 20 working days, and the authenticity of the application materials shall be verified at the relevant site. Conditional provincial coal management bureau for approval; Otherwise, it will not be reported and the applicant will be notified in writing.

(4) Decide

Provincial Coal Management Bureau shall complete the examination within twenty working days from the date of accepting the application. If it cannot be completed within 20 working days, it may be extended for 10 working days with the approval of the person in charge of this administrative organ, and the applicant shall be informed of the reasons for the extension.
