Chapter I General Principles

Article 1 In order to standardize and strengthen the entrusted loan management of housing provident fund in Guiyang City, support employees who have paid housing provident fund to buy self-occupied houses, and prevent capital risks, these measures are formulated in accordance with the Regulations on the Management of Housing Provident Fund (Order No.350 of the State Council), the General Principles of Loans (Order No.2 of the People's Bank of China [1996]) and the Measures for the Management of Housing Provident Fund in Guiyang City.

Article 2 The entrusted loan of Guiyang housing provident fund (hereinafter referred to as "housing provident fund loan") refers to the loan at which the interest rate of housing provident fund loan is applicable to the employees who purchase their own houses within the administrative area of this Municipality and pay the housing provident fund in accordance with the regulations.

Article 4 Guiyang Housing Provident Fund Management Center (hereinafter referred to as "the Provident Fund Center") is responsible for the approval and management of housing provident fund loans in the whole city.

The Provident Fund Center entrusts commercial banks and their subordinate branches (hereinafter referred to as "entrusted banks") to handle specific loan business and financial business related to housing provident fund loans.

Article 5 A provident fund center shall sign a written entrustment agreement with the entrusted bank. The provident fund center shall inspect and supervise the use of entrusted loan funds in accordance with the entrustment agreement, and the entrusted bank shall accept the regular or irregular supervision, inspection and comprehensive assessment of the provident fund center in accordance with the entrustment agreement.

Chapter II Loan Objects and Loan Conditions

Article 6 The loan target refers to the employees who have paid the housing provident fund according to the regulations. Including employees who have paid housing provident fund in this city and employees who have paid housing provident fund in accordance with the provisions of this city's off-site loans.

Article 7 Employees applying for housing provident fund loans shall meet the following conditions:

(a) the continuous deposit of housing provident fund has reached the prescribed time limit.

(2) Having full capacity for civil conduct.

(3) Have the ability to repay the loan principal and interest.

(4) Having a good credit record.

(5) There are procurement contracts, agreements or other approval documents that meet the legal requirements and guarantee conditions.

(6) The down payment for house purchase has been paid as required.

Article 8 When employees apply for housing provident fund loans, they shall provide the following materials to the provident fund center in accordance with state regulations:

(1) Identity certificate: including valid identity documents such as resident identity card and household registration book.

(2) Proof of marital status: including marriage certificate, divorce certificate, etc.

(3) proof of down payment: if you buy a new self-occupied house, provide the invoice or receipt issued by the selling unit; If you buy a second-hand house, you should provide a receipt or payment certificate issued by the seller or a qualified third party.

(4) Proof of loan purpose: the loan is used to purchase self-occupied houses, and the purchase contract (agreement) or other supporting documents filed by the real estate administrative department are provided.

(5) Loan guarantee information: If the loan is mortgaged, the mortgage list, ownership certificate and certificate of consent to mortgage issued by the person who has the right to dispose of it shall be provided.

(6) Personal credit information: the inquiry authorization and personal credit report of the personal credit information system of the People's Bank of China.

(7) Loan collection account information.

(8) Other documents or materials.

Article 9 The credit records of employees' use of housing provident fund shall serve as an important basis for the examination and approval of housing provident fund loans. Employees who break their promises in the use of housing provident fund may be restricted or refused to apply for housing provident fund loans.

Chapter III Loan Amount, Term and Interest Rate

Tenth housing provident fund loan amount should be determined according to the monthly salary base, repayment ability, deposit balance, loan period and other factors. The calculation formula is as follows:

Employee loan amount = employee (husband and wife) monthly paid salary base × 12× repayment ability coefficient (30%)× loan period+employee (husband and wife) paid balance ×5 times. If the "employee (husband and wife) deposit balance" in the calculation formula is less than 30,000 yuan, it shall be calculated as 30,000 yuan.

The maximum loan amount shall be implemented according to the regulations of Guiyang Housing Provident Fund Management Committee, and shall not exceed the remaining house payment payable.

Eleventh housing provident fund loan period is determined according to the following circumstances:

(a) housing provident fund loans issued with newly-built houses purchased as collateral, the loan period generally does not exceed the period from the date of issuing entrusted loans to the legal retirement age, and the longest period is not more than 30 years.

(two) the housing provident fund loans issued with the purchased second-hand houses as collateral, the sum of the housing age and the loan life shall not exceed the land use life.

(3) The term of the housing provident fund loan may be appropriately extended, and the longest extension period shall not exceed 5 years, and the extension period shall not exceed 30 years.

Twelfth housing provident fund loan interest rates in accordance with the relevant provisions of the state. In case of interest rate adjustment during the loan term, the new interest rate standard (65438+ 1) will be implemented from the following year.

Chapter IV Loan Procedures

Fourteenth employees to apply for housing provident fund loans according to the following procedures:

(1) application. Employees shall submit the Application Form for Housing Provident Fund Loan and related materials to the entrusted bank.

(2) acceptance. After accepting the employee's application, the entrusted bank shall review the employee's relevant situation before lending. After approval, the accepted application materials for housing provident fund loans will be submitted to the provident fund center for approval in a timely manner.

(3) examination and approval. The provident fund center shall complete the examination and approval within 6 working days from the date of accepting the application, and make a decision on whether to grant the loan. For approval, the provident fund center shall inform the employees; If the examination and approval fails, the provident fund center shall explain the reasons to the employees and return the relevant materials provided by the employees.

(4) sign a contract. The loan approved by the provident fund center shall be entrusted by the provident fund center to sign a written loan contract with the borrower.

(5) mortgage loan. After completing the mortgage guarantee procedures, the provident fund center issues loans to borrowers.

Chapter V Loan Guarantee

Fifteenth employees to apply for housing provident fund loans, should use the purchased housing as collateral to provide security for their loans.

Chapter VI Loan Repayment

Sixteenth provident fund center is responsible for the borrower's housing provident fund loans should repay the principal and interest accounting.

Seventeenth borrowers should repay the principal and interest of housing provident fund loans in accordance with the repayment amount and repayment method agreed in the loan contract.

In violation of the provisions of the preceding paragraph, the provident fund center may charge a penalty interest in accordance with the relevant provisions.

Eighteenth borrowers to repay housing provident fund loans in advance, should obtain the consent of the provident fund center, and in accordance with the relevant provisions of the early repayment procedures.

Chapter VII Loan Supervision

Article 19 The borrower shall ensure that the housing provident fund loan is used exclusively, and if it is used for other purposes in violation of the agreement, the provident fund center has the right to unilaterally request the entrusted bank to recover the housing provident fund loan in advance.

Article 20 If a borrower fails to meet the conditions for housing provident fund loans and defrauds housing provident fund loans in violation of regulations by deception, the provident fund center shall, after investigation and verification, terminate the loan contract according to law, recover the issued housing provident fund loans, and investigate the legal responsibilities of the relevant responsible persons.

Twenty-first because of the provident fund center, guarantee institutions and entrusted banks irresponsible, dereliction of duty caused by the loss of housing provident fund loans, in accordance with national laws and regulations and the relevant provisions of provinces and cities shall be investigated for legal responsibility.

Chapter VIII Supplementary Provisions

Twenty-second flexible employees apply for housing provident fund loans in accordance with the relevant provisions of this Municipality.

Twenty-third Guiyang City Housing Provident Fund Management Center Railway Sub-center under the jurisdiction of the paid workers to apply for housing provident fund loans, with reference to these measures.

Twenty-fourth provident fund center can formulate specific implementation rules according to these measures.

Article 25 These Measures shall come into force on May 20 19, and the Detailed Rules for the Implementation of Entrusted Housing Provident Fund Loans in Guiyang (No.00/KLOC-0 [2004]) shall be abolished at the same time.
