Who will attend the Party Congress?

Legal analysis: Participants in the Party Congress include party representatives, alternate representatives, specially invited representatives and attendees. Among them, party representatives refer to party members who are elected by the party member conference or party representative conference or party representative meeting and attend the higher-level party congress. The method for the election of deputies to the Party's National Congress shall be decided by the Central Committee, and the method for the election of deputies to the Party's local congresses at all levels shall be decided by the Party committee at the same level and reported to the Party committee at the next higher level for approval. Delegates to the Party’s congresses at all levels are the subjects of the powers of the Party’s congresses at all levels as stipulated in the Party Constitution. The leadership bodies of the Party’s congresses at all levels must ensure that deputies to the Party congresses fully exercise their powers.

Legal basis: Article 11 of the "Constitution of the Communist Party of China" The election of deputies and committees to the party's congresses at all levels must reflect the will of the electors. The election shall be by secret ballot. The list of candidates must be fully discussed by party organizations and electors. Formal elections can be conducted directly by using a margin election method in which the number of candidates is greater than the number of candidates. It is also possible to first use the differential election method to conduct pre-selection, generate a list of candidates, and then conduct a formal election. Electors have the right to learn about candidates, request a change of candidates, not elect any candidate, or elect another. No organization or individual may force electors to elect or not elect someone in any way. If there is a violation of the Party Constitution in the election of the Party’s local congresses at all levels and grass-roots congresses, the party committee at the higher level shall, after investigation and verification, make a decision to invalidate the election and take corresponding measures, and report it to the party at the next higher level.
