2. Can the parties refuse the online trial?

The answer is yes. The notice issued by the Supreme Law clearly pointed out that people's courts at all levels should actively and orderly promote and standardize online trials, and comprehensively consider factors such as technical conditions, case conditions and the wishes of the parties to determine whether to adopt online trials. Civil and commercial cases and administrative cases can generally be tried online. However, if both parties do not agree to the online trial, do not have the technical conditions for online trial, and need to find out the identity on the spot, check the original, check the real thing, etc. , online trial is not applicable.

If the parties do not agree to handle the case online and apply for an extension of the trial according to law, the people's court shall allow it, and online litigation is not mandatory. The people's court may suspend the proceedings if it complies with the relevant provisions of the procedural law on suspension of trial.
