Regulations of Beijing Municipality on the Protection of the Rights and Interests of Ethnic Minorities

Chapter I General Provisions Article 1 In order to protect the legitimate rights and interests of ethnic minorities, maintain and develop socialist ethnic relations of equality, unity and mutual assistance, and promote the common prosperity of all ethnic groups, these Regulations are formulated in accordance with the Constitution, relevant laws and regulations and the actual situation of this Municipality. Article 2 These Regulations shall apply to ethnic groups other than the Han nationality recognized by the state living within the administrative area of this Municipality. Article 3 Citizens of ethnic minorities shall enjoy the rights and fulfill the obligations stipulated in the Constitution and laws.

No organization or individual may infringe upon the legitimate rights and interests of minority citizens. Ethnic discrimination and acts that undermine ethnic unity and ethnic relations are prohibited. Article 4 All units in this Municipality shall educate citizens of all ethnic groups on national policies and national unity. Article 5 The people's governments at all levels in this Municipality shall incorporate the economic, cultural, educational, scientific and technological undertakings that meet the needs of ethnic minorities into the national economic and social development plan.

People's governments at all levels and relevant competent departments shall arrange the funds needed for the economic, cultural, educational, scientific and technological development of ethnic minorities according to their financial resources. Article 6 The municipal administrative department of ethnic affairs shall be responsible for ethnic affairs within the administrative area of this Municipality; The district and county administrative departments of ethnic affairs shall be responsible for ethnic affairs within their respective jurisdictions. Article 7 Citizens of ethnic minorities have the right to lodge complaints or charges against acts that infringe upon their legitimate rights and interests, and the relevant state organs must deal with them promptly according to law. Chapter II Safeguarding Political Equal Rights Article 8 The people's congresses of cities, districts, counties, ethnic townships and townships and towns with a certain number of ethnic minorities shall have representatives of ethnic minorities.

The election of representatives of ethnic minorities to the people's congresses at various levels in this Municipality shall be conducted in accordance with the Election Law of the People's Republic of China on the National People's Congress and local people's congresses at various levels and the relevant provisions of this Municipality. Article 9 State organs at all levels in this Municipality guarantee the rights of ethnic minorities to participate in the management of state affairs. When formulating important policies and decisions involving ethnic minorities and handling important issues involving ethnic minorities, we should listen to the opinions of ethnic minority representatives and give play to the positive role of ethnic minorities in developing economy, maintaining social stability and promoting social unity and progress. Article 10 People's governments at all levels in this Municipality shall make plans and take measures to select, train and use minority cadres in a planned way.

The people's governments and sub-district offices of districts, counties, townships and towns with a large minority population, as well as units and departments recognized by the state and this Municipality that directly serve the production and life of ethnic minorities, shall be equipped with leading members and staff of ethnic minorities. Eleventh ethnic minority population reached more than 30% of the total population of the township administrative region, ethnic townships can be established; Under special circumstances, it can be slightly lower than this ratio. The heads of ethnic townships shall be ethnic citizens who have established ethnic townships. The establishment, merger and cancellation of ethnic townships shall be examined and approved by the district and county people's governments at the Municipal People's government.

Villages with ethnic minorities accounting for more than 30% of the total population may apply to the district or county people's governments for recognition as ethnic villages.

The main leading members of ethnic villages should include ethnic citizens who have established ethnic villages. Article 12 Citizens of ethnic minorities shall enjoy equal employment and the right to choose a job according to law.

State organs, enterprises and institutions at all levels in this Municipality shall not discriminate against minority citizens when recruiting, recruiting and hiring personnel. Chapter III Economic Development Article 13 The relevant competent departments of the municipal, district and county people's governments shall arrange certain funds from the special funds arranged in the annual financial budget to support the economic development of ethnic minorities. Fourteenth district and county people's governments in the preparation of the budget in accordance with the principle of preferential treatment for ethnic townships to give care and support to the finances of ethnic townships. Fifteenth municipal, district and county people's governments and their relevant departments shall give priority to ethnic townships and villages when arranging economic and technological development projects and special funds, and carrying out counterpart support and economic and technological cooperation.

The municipal, district and county people's governments and their relevant departments shall help ethnic townships to strengthen infrastructure construction such as agriculture, forestry, water conservancy, electric power and transportation. Article 16 The people's governments at all levels in this Municipality shall take measures to give support to ethnic townships and ethnic villages whose per capita income is lower than that of rural areas in their districts and counties. Article 17 This Municipality encourages the establishment of economic entities that meet the needs of ethnic minorities and the development of products with ethnic characteristics.

The people's governments at all levels in this Municipality and their relevant departments shall provide tax, credit and financial support to ethnic trade and articles enterprises recognized by the state and this Municipality, catering and non-staple food business units with ethnic minorities as the main service targets, and food production and processing enterprises. Chapter IV Development of Education, Culture and Health Article 18 Citizens of ethnic minorities in this Municipality shall enjoy equal educational opportunities according to law.

People's governments at all levels in this Municipality should attach importance to the development of minority education and strengthen leadership and support for minority education. Nineteenth according to the characteristics and needs of ethnic minorities, with the approval of the relevant departments, ethnic schools and kindergartens can be established in areas where ethnic minority citizens are concentrated.

The municipal, district and county education administrative departments should consider supporting minority education when arranging education funds; Help ethnic schools and ethnic kindergartens (institutes) to strengthen the construction of teachers, improve school conditions and improve the quality of education.
