Does the woman propose to return the bride price for divorce?

If the woman and the man do not live together even though they have gone through the marriage registration procedures, and the woman files for divorce, she needs to return the bride price to the man. If the man makes his life difficult because of the bride price he paid to the woman’s family, and the woman files for divorce, she needs to return the bride price to the man’s family. If it does not fall into the above two situations, the woman and the man have registered their marriage, and the woman files for divorce, she does not need to return the man’s bride price.

In Article 10 of the Interpretation (2) of the Supreme People's Court on Several Issues Concerning the Application of the Marriage Law of the People's Republic of China and the People's Republic of China, if a party requests the return of a betrothal gift paid in accordance with customs, if it is found that the following circumstances apply, The People's Court shall support: (1) The parties have not completed the marriage registration procedures; (2) The parties have completed the marriage registration procedures but have not lived together; (3) Pre-marital payments have caused difficulties in the payer's life.
