Is the power of attorney legally binding?

The power of attorney has legal effect. Because the power of attorney is a legal document, it has legal effect.

To entrust a close relative of a party, a social organization or a person recommended by the party as an agent ad litem, an entrustment contract must be signed first, and the power of attorney must prove the entrusted matters and authority. The power of attorney shall be signed or sealed by both the principal and the principal. Then, with the approval of the people's court, the agency is established. If the client is a citizen of China living abroad, his power of attorney must be certified by the embassy or consulate of China in that country, or by patriotic overseas Chinese organizations if there is no embassy, so as to ensure the authenticity of the power of attorney and protect the rights and interests of the parties and the proceedings;

If a party entrusts a lawyer as an agent ad litem, it must go through the entrustment formalities in a law firm. A party may entrust a lawyer and sign an entrustment contract with him after his consent. If a party cannot ask a lawyer to be an agent ad litem by name, it may also ask a law firm to appoint a lawyer as an agent ad litem at will. After signing an entrustment contract with a lawyer, the parties concerned shall pay a certain amount of agency fees to the law firm and submit the power of attorney signed or sealed by both parties to the people's court for examination.

Legal basis: Article 165 of the Civil Code of People's Republic of China (PRC).

If the power of attorney is in written form, the power of attorney shall specify the agent's name, agency matters, authority and time limit, and shall be signed or sealed by the principal.

If several persons are the same agent, they shall jointly exercise the agency right, unless otherwise agreed by the parties.
