Qinghai province anti-drug regulations

Chapter I General Provisions Article 1 In order to prevent and punish drug crimes, protect citizens' physical and mental health, and maintain social order, these Regulations are formulated in accordance with the Anti-drug Law of People's Republic of China (PRC), the Regulations on Drug Rehabilitation and other relevant laws and administrative regulations, and in light of the actual situation of this province. Article 2 These Regulations shall apply to anti-drug publicity and education, anti-drug and drug rehabilitation management and services within the administrative area of this province.

Drugs as mentioned in these Regulations refer to opium, heroin, methamphetamine (ice), morphine, marijuana, cocaine, ketamine and other narcotic drugs and psychotropic substances that can make people addicted as stipulated by the state. Article 3 Drug control is the common responsibility of the whole society. State organs, social organizations, enterprises and institutions, other organizations and citizens shall perform their duties or obligations in drug control according to law. Article 4 Anti-drug work should follow the principle of giving priority to prevention, comprehensive management, banning seeds, drugs, trafficking and smoking, adhere to the principle of combining education with punishment, and combining management with service, and implement the working mechanism of unified leadership of the government, respective responsibilities of relevant departments and extensive participation of society. Article 5 The people's governments at or above the county level shall strengthen their leadership over the drug control work within their respective administrative areas, incorporate the drug control work into the national economic and social development plan, and include the required funds in the fiscal budget at the corresponding level.

The people's governments at or above the county level shall establish and improve the evaluation and accountability system for drug control work, and regard drug control work as an important assessment content for spiritual civilization construction and peace construction. Article 6 The people's governments at or above the county level shall set up the Anti-Drug Committee, which shall be responsible for organizing, coordinating and guiding the anti-drug work within their respective administrative areas, organizing and formulating the anti-drug work plan, and urging the member units of the Anti-Drug Committee and the people's governments at lower levels to complete the annual anti-drug work tasks and other anti-drug work assigned by the anti-drug committees at higher levels and the people's governments at the corresponding levels.

The Anti-Drug Committee shall set up an office to make clear that full-time personnel are responsible for daily work. Article 7 All members of the Narcotics Control Committee shall perform their duties in drug control work according to law, formulate a responsibility system for drug control work, and report the drug control work to the Narcotics Control Committee at the same level on a regular basis.

Public security organs are responsible for drug investigation, drug case investigation, anti-drug publicity, drug addicts investigation and dynamic control, management of the purchase, sale and transportation of precursor chemicals, anti-drug management of entertainment places and business service places, community drug rehabilitation and community rehabilitation guidance and support.

The judicial administrative department is responsible for coordinating the publicity and education of anti-drug rule of law, managing compulsory isolation drug rehabilitation centers and drug rehabilitation places under its jurisdiction, and guiding and supporting community drug rehabilitation and community rehabilitation.

The health department is responsible for the supervision and management of drug rehabilitation medical institutions or medical institutions engaged in drug rehabilitation treatment, and guiding the prevention and treatment of mental disorders caused by drug abuse.

The market supervision and management department is responsible for the supervision and management of the production, operation and purchase of pharmaceutical precursor chemicals.

The emergency management department is responsible for the supervision and management of the production and operation of non-pharmaceutical precursor chemicals.

Other members of the Narcotics Control Committee shall carry out and support drug control work according to their respective responsibilities. Article 8 People's governments at all levels encourage and support social forces to participate in anti-drug publicity and education, drug rehabilitation and other anti-drug social services, strengthen guidance and training for volunteers, and provide necessary working conditions.

Encourage and support social organizations, enterprises, institutions and other organizations and individuals to donate to drug control work, and implement preferential tax policies according to law.

People's governments at all levels can purchase anti-drug social services from social forces through the way of government purchasing services. Article 9 The people's governments at or above the county level shall strengthen the occupational protection and training for drug control personnel, equip them with necessary protective articles according to post requirements, prevent and reduce occupational risks in drug control work, and safeguard the rights and interests of drug control personnel. Article 10 People's governments at or above the county level shall promote the transformation of scientific and technological achievements in drug control, and develop, introduce and popularize advanced drug control technologies, equipment and drug rehabilitation methods.

Encourage institutions of higher learning, scientific research institutions and other units to carry out anti-drug scientific and technological research and personnel training. Eleventh township (town) people's government, street offices should be clear about the anti-drug staff, do a good job in anti-drug publicity and education, community detoxification and other work according to law, and guide the village (neighborhood) committees to implement anti-drug preventive measures.

Village (neighborhood) committees shall, in light of local conditions, stipulate anti-drug contents in village regulations and residents' conventions, strengthen anti-drug publicity and education for village (neighborhood) people and floating population, and assist in anti-drug related work. Twelfth units and individuals are encouraged to report drug-related crimes. People's governments at all levels and relevant departments shall establish a reward and confidentiality system for reporting, keep the information of informants confidential, protect informants according to law, and commend and reward units and individuals who have made meritorious reports.

People's governments at all levels and relevant departments shall commend and reward units and individuals that have made outstanding contributions in drug control work in accordance with relevant regulations. Chapter II Anti-drug Publicity and Education Article 13 The people's governments at or above the county level shall establish and improve the working mechanism of anti-drug publicity and education, combine anti-drug publicity and education with legal, moral, health and popular science education, build or determine fixed anti-drug publicity and education places according to the actual anti-drug work, provide free anti-drug publicity and education services to the society, and enhance the anti-drug awareness of the whole society.

The Narcotics Control Committee and its member units shall compile and produce anti-drug knowledge books, audio-visual products and Internet digital products. Relying on various anti-drug publicity and education bases, popular science museums and mobile publicity and education service stations, we will strengthen anti-drug publicity and education in various forms and focus on anti-drug publicity and education activities at time nodes such as International Anti-Drug Day.
