Maoming fireworks safety management regulations

Chapter I General Provisions Article 1 In order to strengthen the safety management of fireworks and firecrackers, safeguard the public and personal and property safety, and protect and improve the environment, these Regulations are formulated in accordance with the Law of People's Republic of China (PRC) on the Prevention and Control of Air Pollution, the Regulations on the Safety Management of Fireworks and Firecrackers and other relevant laws and regulations, and combined with the actual situation of this Municipality. Article 2 These Regulations shall apply to the operation, transportation, storage, discharge and related supervision and management activities of fireworks and firecrackers within the administrative area of this Municipality. Article 3 The municipal, district (county-level city) people's governments shall strengthen the organization and leadership over the safety management of fireworks and firecrackers, establish a joint meeting system for the safety management of fireworks and firecrackers, improve the responsibility system for the safety management of fireworks and firecrackers, formulate emergency plans for fireworks and firecrackers, and ensure the funds for the safety management of fireworks and firecrackers.

The town people's government and sub-district offices shall implement the responsibility of territorial management and do a good job in the safety management of fireworks and firecrackers. Article 4 The emergency management department shall be responsible for the supervision and management of the safety production of fireworks and firecrackers, investigate and deal with the illegal production, operation and storage of fireworks and firecrackers according to law, and undertake the daily work of the joint meeting of fireworks and firecrackers safety management.

The public security department is responsible for the safety management of fireworks and firecrackers, and investigate and deal with illegal transportation and illegal discharge of fireworks and firecrackers according to law.

Urban management and law enforcement, transportation, market supervision, ecological environment, housing and urban construction, civil affairs, education and other departments shall, in accordance with the division of responsibilities, do a good job in the safety management of fireworks and firecrackers. Fifth state organs, social organizations, enterprises, institutions and other organizations should do a good job in the safety management of fireworks and firecrackers in their own units, and promptly discourage and stop acts that violate the safety management of fireworks and firecrackers.

Residents' committees, villagers' committees and other units shall assist in the safety management of fireworks and firecrackers in their respective areas and strengthen publicity and education. Article 6 The municipal, district (county-level city) people's governments and relevant departments shall regularly carry out publicity and education activities on the safety management of fireworks and firecrackers, and intensify publicity and education during major festivals and annual activities such as the Spring Festival, Lantern Festival, Tomb-Sweeping Day and Double Ninth Festival.

Radio, television, newspapers, official websites and other media shall publicize the safety management of fireworks and firecrackers for public welfare. Seventh any unit or individual has the right to report illegal discharge, illegal storage and illegal production and operation of fireworks and firecrackers. The public security department and the emergency management department shall announce the telephone number and e-mail address of the report to the public to facilitate the public to report.

The emergency management department shall establish a report feedback system for illegal storage, illegal production and illegal operation of fireworks and firecrackers, register and investigate relevant reports in time, and feedback the investigation results to the informants within 15 working days after receiving the report. If it is verified, the whistleblower will be rewarded according to law. Chapter II Management of Operation, Storage and Transportation Safety Article 8 The municipal emergency management department is responsible for the layout planning of fireworks and firecrackers wholesale points in the city, and the district (county-level city) emergency management department is responsible for the layout planning of fireworks and firecrackers retail points within its administrative area. Planning and layout should follow the principles of ensuring safety, unified planning, rational layout, total control and moderate competition. Article 9 The storage warehouses set up by fireworks wholesale enterprises shall meet the requirements of relevant laws and regulations. Wholesale enterprises are prohibited from setting up warehouses in urban built-up areas.

Fireworks and firecrackers wholesale enterprises shall not place drug samples in wholesale or exhibition places. Tenth it is forbidden to set up fireworks retail outlets in the following areas and places:

(1) Areas and places where fireworks and firecrackers are prohibited;

(2) areas where fire fighting vehicles cannot reach smoothly;

(3) Communities with concentrated residents and under bridges and culverts;

(4) Having a living place, or in a building with underground, indoor or overhead pipelines for transporting inflammable and explosive articles such as oil and natural gas;

(5) Underground and semi-basement;

(6) Power lines with a voltage higher than 1kV. Eleventh in line with the "Regulations" and other relevant provisions of the fireworks safety management conditions, you can apply to the municipal emergency management department, according to the law to obtain the "fireworks business (wholesale) license".

In line with the "Regulations on the Safety Management of Fireworks and Firecrackers" and other relevant provisions, you can apply to the emergency management department of your district (county-level city) and obtain the "Fireworks and Firecrackers Business (Retail) License" according to law.

Fireworks wholesale enterprises and retail operators can engage in fireworks business activities only after going through the registration formalities with the market supervision and management department with the Fireworks Business (Wholesale) License or the Fireworks Business (Retail) License. Twelfth fireworks wholesale enterprises to obtain fireworks business (wholesale) license is valid for three years. Those who intend to continue to engage in fireworks and firecrackers wholesale activities after the expiration of the validity period shall apply to the original issuing authority for extension three months before the expiration of the validity period.

The validity period of the fireworks business (retail) license obtained by the fireworks retail operator shall not exceed two years, and the specific period shall be determined by the issuing department. "Fireworks and firecrackers business (retail) license" after the expiration of the validity period intends to continue to engage in fireworks and firecrackers retail business activities, it shall apply to the local district (county-level city) emergency management department three months before the expiration of the validity period.
