What is a patent application?

Patent application is a way for the state to manage patent licensing.

It refers to the behavior of the patent administration department or its entrusted department to keep and publicize the patent licensing contract that has been concluded and taken effect by the parties.

To apply for a patented product:

1, log on to the pilot platform to register;

2. Carry out real-name authentication, fill in basic information, upload certification materials and integrity commitment letter, and then submit it for review. In general, the review period is 1-2 working days;

3. After the real-name authentication is passed, manage the patent information;

4, product filing, fill in the basic information of products, economic data, declare the use of patents, and upload relevant certification materials;

5. The pilot platform checks the product information for filing. The general review period is 3-5 working days, and the record is successful after passing.

To sum up, the products on record should be related to at least one valid China patent without ownership dispute, and achieve good market economic benefits.

Article 5 of the Measures for Filing Patent Licensing Contracts

The parties concerned shall go through the filing formalities within 3 months from the effective date of the patent licensing contract.

Article 8 To apply for filing a patent licensing contract, the following documents shall be submitted:

(1) An application form for filing a patent licensing contract signed or sealed by the licensor or the patent agency entrusted by it;

(2) Patent licensing contracts;

(3) Identification certificates of both parties;

(4) Where a patent agency is entrusted, a power of attorney;

(5) Other materials that need to be provided.
